Govt to introduce controversial Treaty Principles Bill this Thursday

In its first report following an inquiry in May, the Waitangi Tribunal found the Bill would effectively rewrite the Treaty of Waitangi.

It also said it was a solution to a problem that did not exist and little more than a “politically motivated attack on perceived Māori privilege”.

Cabinet released more details about the proposed principles in September, prompting a second hearing by the Tribunal last month.

The latest report, based on the second hearing, was just as scathing.

“We found that if this Bill were to be enacted, it would be the worst, most comprehensive breach of the Te Tiriti in modern times,” it read.

“If the Bill remained on the statute book for a considerable time or was never repealed, it could mean the end of the Treaty.”

The new report said if the Bill progressed, the damage to the Māori Crown relationship would be profound.

“Underlying the significant change across all statutory regimes that affect Māori, the Bill would end the Treaty partnership and any formal relationship between the Crown and Māori.

“At present, the progressing of the Bill is having serious impacts on the relationship but the Bill if enacted would kill that relationship. This is deliberate.”

When the Waitangi Tribunal is warning that this piece of legislation risks threatening all the work the Crown and Māori have made, we should probably sit up and take note.

…Māori and those who came after 1840 have worked to find pragmatic ways of fulfilling the Treaty, yet ACT are so ideologically driven all they want to do is undermine that pragmatism with this Referendum Bill!

The late, not so great member of Parliament, James Richmond, wrote in 1851:

“I look forward to the day when the preposterous Treaty of Waitangi will be overruled and the ridiculous claims of the natives to thousands of acres of untrodden bush and fern will no longer be able to dampen the ardour and cramp the energies of the industrious white man”.

How is that 19th Century White Settler privilege vibe any different to what ACT are preposing today and aren’t Maori sick of this crap?

Former Attorney General Chris Finlayson says the Treaty was between the Crown and the Maori Chiefs who signed it, where as ACT are misrepresenting the Treaty as between races and because they do this, they come to the wrong conclusions.

Treaty’s are supposed to be honoured not settled.

There are 2 versions of the Treaty, most Māori signed the Māori version, we are signed up to UN Declarations that state when there are two versions of a Treaty, the version in the indigenous language takes precedence meaning Māori did not cede sovereignty – the Principles were an attempt to recognise this – why crush the pragmatism for ideological fervour?

It is intellectually repellent to allow the majority to vote on the rights of the minority – how is this Bill – that has no chance of passing – so how is this entire exercise anything other than a divisive race baiting stunt?

Andrea Vance writing about ACTs rise in the polls said:

“The party has re-risen by stoking a culture war, peddling identity policies and putting a tale of Pākehā grievance at the heart of party identity.”

How is any of that a good faith debate on race?

Sir Geoffry Palmer in the 2013 Māori Law Journal wrote:

If there is one thing that is unique about New Zealand it is that the indigenous inhabitants of the country are Māori. They have their own language, culture and way of thinking. They were subjected to rank injustice in colonial times. It has taken a long time to remedy those injustices, and the process is not yet complete. Unfortunately disguised prejudice is never far from the surface in New Zealand whenever there is a debate on Māori issues. There is an unpleasant underside to the New Zealand psyche when questions of race are debated. These things I learned only by exposure to the issues in Parliament. Many years later I still get letters blaming me for elevating the status of the Treaty of Waitangi. I remain unapologetic, I would raise it further. I thought then and I still think now that the most serious challenge New Zealand faces is to avoid having a permanent underclass defined by race.

Dame Anne Salmon says:

“Debate the Treaty by all means. But let it be just and impartial, as befits a constitutional discussion, and not conducted on the basis of a bill that is highly partisan, and designed to provoke ill-will and anger.”

This debate is designed to cause redneck backlash, not contain it.

And what is National’s message to the bottom feeders throughout all of this?

National, ACT and NZF are destroying the common good for their donor interests and NZers were manipulated into voting for them.

This is why we are seeing Roy Morgan polling showing the electorate recoiling in disgust at the venal self interest of these treacherous elites.

    • This is blatant racism – How is it that new, New Zealanders are stealing their own country? Is it because they arrive in NZ determined to make a better life for themselves and their families? Is it because they work hard and build successful businesses by providing goods and services to all Kiwis? Is it because they value education and family values that often sees their children go on to succeed in professional careers and in doing so leapfrog up the social hierarchy?

      Or is it because they prove that NZ really is a wonderful egalitarian country where anyone regardless of race or class can make something of themselves? NZ isn’t perfect but it’s a damn sight better than just about anywhere else on earth.

        TRy going to the bank as a maori to get a loan to buy the local dairy or set up a vape shop .
        Two local vape shops are owned by people that cant even speak english but clearly the bank was happy to lend them a couple of hundred k to set up and buy stock .
        If the Maori digger driver wanted to buy the digger the bank would say no even though his business would be contributing to NZ and the vape shop is selling ill health which in no way contributes to NZ .

        • These days almost everyone agrees colonisation is a bad thing. Yet since Bolger effectively said “we are all Asian now” locals have had an extra 60 percent population increase thrust upon them. This overimmigration has caused heaps of problems around infrastructure and culture. The neocolonialists don’t see themselves as a party to the treaty as they weren’t part of the British Empire. Back in the nineties the debate about NZ being bicultural or multicultural was lost to Nationals business interests.

          Either a Treaty is honored and property rights respected or you have the ruling class impose its whims like in authoritarianists.

          The idea this law won’t get passed is highly suspect. The strategy, Act introduce bill, have a long period of whipping up racial fervor dressed up as equal rights, get the wind blowing in the right direction, get some right opinion polls, manipulate Luxon and Winston into a “how can you be against equal rights and the will of the pollsters” capitulation to this BS.

          Then a bunch of overseas businesses can get greater open slather access to the countries resources without tetchy maori soverignists slowing them down.

The three idiots need to read the article on RNZ news early in the week headed MAORI ECONOMY GROWING FAST ,there are some interesting comments around how indegenous Americans have way better deal than Maori have from the red necks .Hell they have their own health system and are sovereign over their land .They have their own police force even .And before the rednecks get on the high horse they fund these things from their own economy so no the white bible bashers are not paying for it .

Watching Seymour interview on the Hui with Julian Wilcox the other day was torturous where he kept implying to the interviewer that he was promoting racism by saying “what good for maori is good for NZ” Seymour has certainly got his slogans and punchlines well rehearsed and comes across as an entitled expert on our country history calling professional in their field of expertise wrong than follows up with an unfounded assumption it just machiavellian hilarious doublespeak

    He certainly invested in pushing the boundaries of race relations and accuses people of advocating anything Maori as promoting racism. The entitlement of this little cunt playing to the worst of NZers darkest thoughts and IMO this is deliberate to elicit a violent response and he could well get his wish?

    Tolerance is difficult to practice in the best of environments so to promote separatism disguised as equality further solidifies 19 century settler society attitudes advocating violent response whether explicit or implicit was a key component to keeping maori marginalized that made land appropriation effortlessly but this time it will affect pakeha who own this country now more so because colonisation is still continuing and the new settlers arriving surpasses maori & pakeha combined.

    • Maybe we need to put that into practice and do away with the party vote .So then you would have just one vote as you would be voting for the best candidate in your voting area .Then we could do away with political parties all together which would cut the waste on donating to parties to gain favours for a select few rich people .Then you could just have a maximum amount a candidate can spend on advertising .Before long we will be having the same problem as in the USA where us rich white males fund whom ever will give us the biggest tax brake or allow us to mine and drill till the world is extinct .
      We would end up with a far better government if we did away with political parties .The same would apply to councils where party politics has destroyed the ability to progress great sevices .

  5. I am a Treaty purist. I don’t care about The Principles. Article 2 gave Maori the right to retain their land. There is no full and final settlement until all land that was taken, by force of arms, by confiscation or by other settler government legislation is returned to iwi/hapu ownership.

  6. David makes the point that every child born is equal when they are born .That is true for the first 1 hour after that hour the equality is gone .
    How can a Maori child born into a family whose land was stolen 180 years ago be seen as being equal to the kid whose family now owns that land and whose ancestors have earned a few million off that land .Those millions should have been earned by his or hers Whanau which would give that child a better start in life .
    How can those kids be equal when for generations their forbears were deniged the right to equal education and income along with housing .When he adresses those land and income issues then I will be happy to talk to him and see him as a decent person .

Bullshit Yeti it was our country (Maori) most of our land was confiscated by the pen, we were forbidden to speak our language for 50 years, we did not get the state benefits many Pakeha whanau got from our welfare state and governments that ruled for the majority. We did not go into the land ballots after war, and our servicemen did not receive the same level of pensions. And don’t say Māori do not want the best for our kids most of us do., but we also want our kids to know where they came from and know their culture, we have a right to be Māori and we use to be made to feel ashamed but not anymore.
