It keeps popping up in the news, and I really really really think we need to be paying attention to it…

‘Unfair’ Police interview process forced false confession, says judge

A controversial police interrogation method that was implicated in a false confession is under fire from human rights lawyers, criminologists and psychologists.

Earlier this month, Crown Law and police lost their legal battle to keep secret the method used in the Lois Tolley murder case, which collapsed late last year.

The case unravelled against Mr X (one of three men charged over the crime), after his so-called “confession” turned out to be a fabrication, obtained by dubious means.

Those dubious means were finally revealed after the news organisation Stuff took legal action to get suppressions lifted on a High Court judgment.

This Trick Bullying a confession is euphemistically called the Complex Investigation Phased Engagement Model (CIPEM) and it was defended at the time by its architect, Detective Superintendent Tom Fitzgerald…

The architect of a controversial police interviewing method has defended its use, saying it’s not to blame for the false confession extracted from a murder suspect.

It comes after a High Court judge said that detectives trained in the Complex Investigation Phased Engagement Model (CIPEM) misled the man, and “manipulated” him to make a confession that was “very flawed” and “not credible”.

In an interview with Stuff last week, Detective Superintendent Tom Fitzgerald, who is in charge of the police’s national crime group, and who created CIPEM, insisted any issues were the result of mistakes by the detectives involved, not a flawed model.

“You can’t blame the model for what happens in one interview.”

…so according to the architect of this interrogation model, it’s not the interrogation models fault for a questionable confession being thrown out, it’s the way poorly trained detectives use it?

Yet it then turns out, that the architect of this interrogation model, the one he’s claiming isn’t flawed because but was poorly trained detectives who screwed up, was actually intimately involved in the interrogation…

Stuff can now reveal that Fitzgerald helped plan the suspect’s interviews and watched them unfold from an adjacent room – offering advice and direction to the two detectives as required.“He needs to take responsibility for what happened,” a police source said. “If something goes wrong, it needs to come back to the person at the top. Claiming it was operator error is simply devolving responsibility for something that he implemented.”

…we wonder how Alan Hall was bullied into a false confession? These types of tactics.

It looks like the Police simply round up a group of possible suspects and bully one of them into a confession.

How is this possible and how many innocent people are actually in our prisons if the cops are playing games of entrapment?

    • and how many murder convictions get overturned(eventually) because of inept or corrupt police work…and don’t get me started on peter ellis who went down for ‘sounding like a puff’

          the facxt is his voice and a cabal of lesbian separatists sent an innocent man down and the NZ judiciary colluded several times in whitewashing a deeply deeply flawed investigation though I do hesitate to dignify a witch hunt with the word investigation

  2. Totally against this type of interrogation – police are concentrating on the easy target and not getting to the evidence of what went on. Years later, these are overturned.

    What is happening to NZ police, when NZ police are helping car criminals legally steal cars and crims can do it for $9 and get the police to kick out the legal owners of cars and give to the criminals!!!! Wouldn’t you think they would check for evidence of who owns a car, before arresting people?

    NZ Finest – apparently they were about to crush the car, the body may never have been discovered, and nobody has reported this woman missing. Then the crime scene is contaminated by not discovering the body when it was first called in. Really, what would a sheep be doing in a car? Pulling the wool over the officer’s eyes?

    There is something very wrong with where the NZ police force is going, if they can’t find dead bodies and people are killing others and it’s a fluke their bodies are discovered, aka murder and torture of teenager Dimetrius Pairama.

    Not really creating trust in the community!

  3. The true extent of what the Police and agencies will do to people not convicted of a crime will likely never be known. Should one of them flip out and put a hammer through the scull of an American serviceman at the US Antarctic base at Christchurch earthquake, they might come to be known.

  4. and today we have illegal photos which no one will ever carry the can for…so where’s the discouragement not to repeat THEIR illegal acts…after all a bit of stir is supposed to discourage ram raiders why not law breaking cops?
