Supreme Court decision to allow extradition to China causes global concern
Politicians across Western democracies are concerned by the decision of New Zealand’s Supreme Court to allow extradition to China.
The top court said it was comfortable with China’s assurances that a New Zealand resident, Kyung Yup Kim, would receive a fair trial in China, on a charger of murder.
ACT leader David Seymour joined the chorus of human rights advocates on Thursday, calling the Supreme Court’s decision “completely wrong”.
“If they seriously think a person is going to get a fair trial in a country run by the CCP, then they’re dreaming,” he said.
…this exact same situation is being played out with Kim Dotcom, except with Kim, the crimes he’s accused of by America aren’t actually on the extradition list.
The Supreme Court is not just the embodiment of independent NZ justice and law, it’s supposed to stand for the values of NZ as well!
Sending a NZ resident back to a corrupt Communist regime who abuse the rule of law is NOT a NZ value.

The issue is that our court system rests on punishment and denunciation. These are the guiding principles, not some high minded adoration of fairness and decency that you lament the lack of. Our courts have evolved into an injustice system, one where the most fundimental pillar of our system of laws, the presumption of innocence has become inverted so that the onus of proof has shifted from Crown to Defendant and the evidential threshold
has become “I said so” or perhaps
“me too”

Agree – however the fight against Dotcom is political and is is a far greater human right abuse than extradition for a murder charge.
NZ’s legal system is shameful and setting precedents that should not be set in the Dotcom case because copywrite was not a crime in NZ, not able to be used to extradite and the agencies gathering information acted illegally to ‘bolster’ their case to try and get the extradition.
Bad for USA as a leader and why so many in the west and world, are turning against the US and saying that countries like China and Russia are better for human rights and more peaceful.
Dotcom is one of those situations where a rich but corrupt industry (film making) has the ability to influence US politics to the extent they go on this witch hunt which hurts the US and NZ reputations, but they can’t seem to stop themselves.
SaveNZ I am not sure it is correct to say copyright infringement in NZ is not a crime. I think its generally a civil case but the Copy right Act and Trade Mark Act do contain criminal provisions don’t they?
Should Kim Dotcom be extradited? I have no idea and from what you say there is no legal basis but, that issue aside, if he profited handsomely off essentially using other peoples assets, or stealing the use of them, (and was found guilty as such) why is he any different than someone who steals and sells peoples chattels (from say their house)? Its all very well to say Hollywood is corrupt but how does that make his theft somehow righteous?
when was the last time anyone was prosecuted for downloading a film? I think if you ‘sell it on’ you might have an issue, when was the last time you even saw a bootleg dvd?

This case was already heard in the USA because You Tube and many other Internet sites like them did the same thing as Dotcom (aka was facing copywrite charges) and it has already been found in favour of You Tube.

This was a civil case and if the US film industry wanted to sue Dotcom they should have paid for it themselves in civil court (like the You Tube case) instead of getting the FBI and NZ government to pay for their court case over years (is it over a decade now – if this was private litigation it would have been settled within a few years and NZ taxpayers not paying for it) .
Sony declined to be involved with the Dotcom case because they did not think they would win.
This and other cases like it, is why people no longer believe that government is acting in peoples best interest but are corrupted by corporations.
Similar when Jeffrey Epstein preyed on children but the US government officials protected him from prosecution for decades and did not prosecute, likewise Harvey Weinstein’s sexual offences.

Ok so you are saying the Viacom case was civil and I guess set precedent as to why he should no be charged. Fair enough. The charges against the Kim Dotcom that we are talking about were raised in 2012 and included criminal charges ( copyright and money laundering).
Hollywood is probably all you say it is and looking at Kim Dotcoms history of charges from Germany including embezzlement (he fled to Thailand to attempt to dodge these) and some other dodgy dealings in Hong Kong, it sounds like they are made for each other.
Whatever charges Dotcom had against him previously did not seem to stop him getting NZ permanent residency/citizenship…..
People like John Banks seemed pretty keen to take his donations when it suited them.
The only reason NZ government seemed to bother to go after William Yan’s aka Bill Liu’s whose estimated tens/hundreds of millions in money laundering at SkyCity was ignored by authorities until he invested in one of DotComs companies. Then they prosecuted him with a secret deal with China in $43 million money laundering case and four months house arrest in NZ in his penthouse. (Justice for all! Sarcasm)
The Dotcom case is politically motivated and – the copywrite should have been settled in NZ civil court by the film makers (where it probably would have been thrown out as was not illegal) not paid for by NZ taxpayers on behalf of the FBI of behalf of the film studios, with further charges obtained after illegal surveillance/police action.
You would think the human rights legal brigade would be all over this, but apparently only want to keep terrorists and murderers in NZ not political extradition cases which essentially this one is.
It is not about the likability of Dotcom but the entire debacle seems to smell really bad for international justice.
China NEVER sent its citizens to trial overseas …one its citizens are in China, they are not sent overseas to face trial.
China probably threatened New Zealand economically if they didn’t get what they wanted. This is really all about money, not justice. Same with Kim DotCom, which is why imo he will ultimately get extradited.
We put all out eggs in the China basket, and we effectively signed away our sovereignty before the ink was dry on the “free trade” agreement.
The big test will happen the instant China invades Taiwan (which WILL happen), and we will be forced to choose between the US and China. I suspect we’ll desperately try and “remain neutral”. Can’t wait for the political shit show that will result.

The only reason not to extradite is if there is evidence that the Chinese courts corruptly handle criminal cases.
