Covid 19 coronavirus: Lockdown unlawful for first nine days, High Court finds, but says action was justified

The first nine days of lockdown were unlawful, a High Court decision says.

New Zealanders were not actually required by law to stay at home in their bubbles until April 3, more than a week into lockdown, today’s ruling has found.

As New Zealanders, we should be grateful & proud of how the High Court ruled on the legality of the first 9 days under Lockdown.

This is proof of the system working & should eliminate the conspiracy fears of a Police State.

This law breach wasn’t malicious tyranny, it was for public health & pardonable.

We need to have these checks and balances on power ESPECIALLY when we are suspending  civil liberties for public health.

Ramifications are for anyone arrested during those 9 days.

The issue is a legal technicality (Bloomfield had the power, but he didn’t initiate it properly) rather than evidence of a plot to take over the country as Gerry Brownlee, Billy TK, the new Conservatives and Brenton Tarrant seem to believe.

This is our Civil Rights working under unique pressures, we should all feel deeply proud of this ruling.

The Government got it wrong, but only in the technical roll out of the powers, and they got it wrong while trying to protect the country from a full blown pandemic.

This is all forgivable in the minds of the voters it saved.

  1. Agreed – a black eye on St Ash & Parker however and I note a still refusal to release crown law advice. I’m fairly sure it would have parroted what the High Court said.

    I vaguely remember Simon Bridges offered assistance to ensure the lock downs were legal but was refused because Parker knew better….

    We ever had any sign of the high court over-viewing any public health or Human rights beaches during nationals nine years of malicious tyranny,

    • Now Judeth Collins is promising blue tooth reporting and no citizens will be re-admitted if they dont show negative, so we ask what testing procedure will she use?

      Will Collins only use the PCR (swab test) which other experts now claim not to be accurate to a “gold standard (as PCR test can show 20% false negatives) or will she use the more accurate “Roache serology antibody test” with 99.8 accuracy? I hope she states this before election time.

      I hope she states this before election time.

I dunno if anyone else has been noticing, but one of the things which has occurred in the US following the dim party rollout of its ‘no policies, cos we’re the lesser of two evils’ election strategy is that the dims’ lead over orange idjit has faded away, down into margin of error territory. Jimmy Dore explains.

    So what? Well I can see the same thing happening here, now that the election has been delayed by a month plus the media & Collins’ white ant of the Covid 19 strategy has been joined by that treacherous whore Winston Peters.

    Ardern’s Ms Nice demeanor has a major flaw, the parliamentary labour party has no head-kicker. No Trevor Mallard who opposition spruikers had to factor into their plans to tear the government a new one.
    Right now any sleazily deceitful pol can say anything they like about the current Labour led covid strategy and have no worries about payback. No loudmouth prop is going to get up onto his hindlegs to call out “Hmm, if you believe that Collin,s why did your government rip n hundred million dollars out of community health – the very arm of health which is most needed in a pandemic?” Or “Winnie, I get it, I know you’re upset at your low polling numbers and all, but surely you haven’t forgotten that it was you who tried to hold this administration to ransom by prioritising millions being spent on a racetrack against the cost of meaningful regulation of care homes for the elderly? You know for the voters you claim to most care about who have been dying in great numbers through this pandemic.”

    When any natz, nz1st or act pol, even a lowly first term backbencher takes a swing at Ardern or her government, all Ardern can do is drag out the well worn ships & mirrors ploy, “I’ll take it onboard and look into it”. The type of response which never gets as much coverage as the initial claim, so the opposition is secure knowing every swing takes a bit more off the Ardern ‘shine’.
    It isn’t impossible for the natz to make up this lost ground.

    The Ardern plan relies on Covid not getting out of hand, yet as we have seen over the last two weeks the government’s control over that is limited and anything could happen.
    If the worst happens it will be too late to drag out a headbanger then, because that will come across as desperate, even hysterical.
    Get an articulate thug into play now, before the shit has really hit the fan.
    If things don’t go bad Labour would still be ahead, they will benefit from opposition attacks having to be measured against the blowback by counter-attack and crank down the volume.

      I agree, Debsisdead. They are missing a fighter or two (or any). Winston was once in there batting for them, they shouldn’t have relied on that. Who within Labour MPs will stand up and actually fight? That is what is needed now.

      As well, there’s no-one in mainstream media either who is out there batting/ fighting for Labour, while there are plenty of them doing the Nats’ dirty work. The odds are stacked against the govt, media-wise, from what I’ve seen lately.
