  1. Sorry to see so little has be made of this in MSM such a good discussion could be had on this but just be swept under the carpet. The work that went into this case must have been immense and well argued,as always Ian is on the button. Thanks for well thought out piece wish more time be given to this journalism than entitled rich listers kids.

  2. The CTU affiliates need to change the CTU and how it operates currently as an extension of Labour Party policy.

    1. Like the Federated Farmers and Auckland Commerce are an extension of the National party.

  3. Thank you Ian for a well supported analysis of this important case. Well done to the Unions involved.
Can we hope that this court decision and the passing of the FPA Law will start to restore some balancing of the playing field in employment negotiations?

  4. What might follow? Higher costs for Uber, which means higher costs for consumers. Because costs increase, ridership falls. Because of removal of flexibility and because of reduced ridership, Uber drivers leave the industry, further increasing the cost per ride for consumers. Increased wait times for riders, who have to pay more through peak surcharge due to a lack of drivers. Consumers turn instead to cheap personal vehicles, increasing emissions. Eventually consumer choice entirely eliminated with a return to a regulated taxi market with only one fare and unionised drivers working to rule.

    1. If Uber have not been paying fair wages to employees then they were not a viable business just like any other business eg dairies, bottle stores, full stop. Ok, so if fares go up, the surely consumers have a choice about which company they choose.
And using the emissions argument in this case smells like a red herring.

    2. Sean, it would seem that all you care about is cheap goods and services and have no regard for the standard of living provided to the suppliers of those goods and services. Surely there is enough evidence to show that our growing inequality and its consequences have been fueled by our 40 year race to the bottom. We should demand that all workers in Aotearoa receive fair pay and conditions for their labour; and that all companies compete in an equal playing field. If that means less profit for overseas companies, or higher cost for the consumer, that’s just the reality of a fair, balanced, and functioning economy.

  5. This self employed contractor model is bloody rife right through out Nz .
A huge chunk of truck drivers are so called self employed contractors as are the people laying your under floor and ceiling insulation. Taxi drivers and couriers and god knows who else.
