Waatea News Column – Fighting the Police when you can’t see the evidence

I’m in the news this week. I have an ongoing case against the NZ Police in front of the Human Rights Review Tribunal regarding the Police breaching my privacy and my civil rights when Police gained access to my banking records minus a warrant.

The case was part of the flawed Nicky Hager prosecution and it’s taken 5 years to finally get in front of the only Court who can actually hold the Police to account, so imagine my shock and surprise when I learned last week that the Police want to do something never done before at the Human Rights Review Tribunal and hold a secret trial using secret evidence that I can’t see or defend myself against.

The absurdity of fighting a case at the Human Rights Commission against an abuse of power by Police in a secret trial using evidence you can’t defend yourself from is the very definition of a Kafkaesque nightmare.

It is astounding that left wing journalists, bloggers, activists, Māori, Environmentalists, MANA Party, Greenpeace and Green Party all have to accept our erosion of civil rights, yet white supremacists manage to avoid any detection at all.

My case against the Police is set to be fought in July.

    You can hardly recognise NZ as a place of justice anymore! When you see who the MP’s hang out with these days and toady up to, it says a lot about how they are operating and what they believe in which is money, money, money. (Wealth for a few people of course, the masses get just enough to survive on, hense the breaking down of the middle classes throughout the Western world)

  2. Political interference, john key, ANZ and other Ozzie banks as a cartel and not initially police driven. NZDF links with US.

    They are doing as the are told yet should disobey any unlawful direction or suggestion as to their function.

    There is corruption here quite plainly across a number of individuals in politics and Police. They need to be weeded out publicly.

    When a few at the top of Police are in the game where do we turn to sort that out.

    Making it public is a good start.

    Where are the whistle blowers.

  3. There was definitely Political Involvement in this case, hopefully the truth will come out ? Maybe, maybe not ?

  4. Our NZ Police are authoritative and they need to be pulled into line now. I hope you deal to them in court Martyn they need to be put in there place national who are also controlling gave them far too much power and are trying to give them more by allowing searching without warrants.
    We also have old colonial views held by many of our ageing police force who need to retire mostly old pakeha men.

    THEREFORE

    The problem you face, in my view, is that the Establishment has set up a System (legal process) which will ensure the Establishment wins.

    If that’s the outcome and the Bradbury Case becomes the precedent which undermines the next decade of Rights Issues – the country which should remember you as a champion of democratic freedom, will damn you for pulling down the pillars of freedom of expression upon yourself and them.

    • Well Martin Luther King Jr. would Be the first to say that he was the spokesperson for the Civil Rights movement, and that he didn’t create the civil rights movement. By the time MLK had come along young black men had already been challenging the establish hegemony over them. They were already fighting segregation with weapons and fists, riding freedom buses, and through what ever means this chaos brought force it’s spokesperson in Martin Luther King.

      Voltaire himself would have instantly recognised the conditions for nurturing such leadership because Voltaire was arrested at the age of 14 and jailed for criticising the Church and the Monarchy and would write his first book stressing the importance of freedoms of speech. Voltaire died before the French Revolution but his work didn’t just influence France it was embodied in The U.S constitution under freedoms of speech and had a huge influence in on art.

      I may not be a political wizard like your Jacinda’s, Winston’s or Bridge’s but I know what power is. I want to be brief so I’ll touch on some macro indicators and a lot of what drives power formation in The South Pacific, we tend to look at demographics and economic size, military weight and so on and the future of New Zealand in the South Pacific doesn’t involve conflict in a thousand word essay when you think about this stuff. The major pacific island centres which New Zealand is a part of is not going to expand its population by double or triple figures as some demographers fear, it will probably top out at 10 million across the South Pacific.

      So the mere fact is demographic weight alone doesn’t infer power. Our geography doesn’t change, its the degree of connectivity that changes and determines the degree to which individuals hold relevant power with in the system. And what is happening now is not only is New Zealand the demographic centre of The South Pacific power scale which is to say we are becoming ever more a system.

      When we talk about the story of New Zealand since World War Two it is told with ever increasing colour but I would remind every one that New Zealand didn’t form in a zero sum game of competing binary interests so we think about these trade wars in micro terms of competition between these hegemonic power structures and lesser struggles which is a committing between the government and corporations vs small town activists and poor workers.

      So I just want to remind every one that the story of New Zealand is not one of competing blocks between powerful pier to pier nations with in the South Pacific region but rather mutually reinforcing waves of immigrants.

    • I agree Ross, the Establishment wins, the only reason to do this is because they have done something far more illegal than hacking his bank accounts illegally and don’t want the populace to know. We know! But he will never let his name be used in this way, to set a precedence for the future. So in the same way the White supremacist chose peace loving NZ to commit his acts, the Establishment have decided to use the same philosophy on Martyn, they know his beliefs, they think they know him and that he wont risk it…..when you take away from someone their reason to live they will take flight or fight…he will fight!
