Pitiful response to Housing NZ meth hysteria

The “pocket money” offer to state house tenants wrongly evicted from their homes based on bogus meth testing is deeply cynical and insulting.

These families had their lives turned upside down by Housing New Zealand’s incompetent, abusive behaviour.

They deserve the level of compensation they would receive if they could afford to take legal action against Housing New Zealand.

They should be treated in the same spirit as farmers who were recently allocated $500 million in compensation for the Mycoplasma Bovis outbreak and the wealthy investors in South Canterbury Finance who were compensated $1.7 billion by National in 2010.

The offer of up to $3000 is despicable.

We (State Housing Action Network) told Housing Minister Phil Twyford that HNZ cannot be trusted to treat residents fairly, reasonably and respectfully and that compensation must be negotiated through an independent agency.

Twyford said no and HNZ made their pitiful response today – underlining their lack of competence or compassion.

And their public announcement carefully timed to be buried under the Tax Working Group interim report.

Based on our legal advice Housing New Zealand has breached the Residential Tenancies Act, its own tenancy agreements and has failed in its common law duty of care to its tenants.

Depending on the circumstances evicted tenants may be able to claim:

(i)                  Apologies for the stress, hurt and humiliation caused by the misapplication of the testing guidelines resulting in eviction.

(ii)                Substantial compensation for the illegal disposal of any of their possessions by Housing New Zealand. Additional compensation should be claimed for emotional loss relating to disposal of irreplaceable personal items of emotional significance eg wedding photos.

(iii)              Repayment of any money paid to HNZ for meth testing or remediation carried out under the bogus meth standards.

(iv)               Repayment of rent paid in the private sector above what the tenant was paying to HNZ from the time they were evicted until they are reinstated in HNZ Income Related Rent Tenancy.

(v)                Damages for stress, hurt and humiliation.

(vi)               Exemplary damages.

(vii)             Being placed on the HNZ/WINZ priority list for a state house in a mutually agreed area.

(viii)           That HNZ apply to the Tenancy Tribunal to quash any Tribunal decisions relating to the tenant which could negatively affect their future chances of obtaining a tenancy.

(ix)               Any legal expenses incurred by the tenant in the pursuit of a claim.

(x)                 All compensation payments to be made ex gratia and NOT to be treated as income by HNZ or WINZ.

And it’s not just those victims directly impacted who must suffer… I don’t want to see poor homeless, poverty stricken bastards living on cardboard boxes as I make my way to a play or movie. THAT DIRECTLY IMPACTS UPON ME ! I don’t want see people suffering for any reason, much less because our politicians are lazy, evil, lying scum bags! Call me selfish if you must.
    The problem is, they don’t fear the public. That’s why the MSM works a very shifty game of diversion to keep us guessing and off-balance. We’re too busy surviving a barrage of pulp media and the insanity inducing pointlessness of the social media era.
    Personally? I believe there’s a far bigger game being played out in our beautiful Aotearoa/New Zealand and the government turning their backs on us with regard to this matter is a formality.

  5. We have treated state house tenants like we treat bobby calves and other animals in this country as dumb , worthless entities who only exist to be bashed , tortured and demeaned with no rights or real meaningful protection.

    The vicious treatment meted out by these cruel and inhuman New Zealanders against their victims is never really acknowledged with serious repercussions when their treatment is publicised and there is no difference whether it is poor New Zealanders in all its forms or innocent animals.

    There is a evil , nasty culture prevalent in this society that seems to be celebrated and encouraged at all levels.
    Our zero respect for life in all its forms unless it is wealthy or serves as a necessary use is a utter indictment of us as a country.
    The only value’s thatare respected is greed and intolerance.

    I told others of my view of Mr Twyford again and again, he was being defended here and on other blogs by others, he has proved to me and others now, what he is really all about.

    He went into bed with the head of the NZ Initiative (formerly known and the Business Roundtable) years ago. He also fell into the back of former Auckland mayor Len Brown and now Phil Goff, criticising Auckland Council and their Auckland Unitary Plan, as he seemed to want no urban rural boundary and little in limits to intensify zoned areas.

    In the media piece above he was quoted also re this:

    There you go, Mark Todd and Ockham Residential, one key developer in Auckland, and there appear to have been ‘friendly ties’ for some time, between Mr Twyford and that developer, who he appeared to favour.

    But while some time ago favourable comments on Mr Twyford were found on their website, it appears to have been ‘cleansed’ since then so it only says stuff like this:

    There will be other ties Phil has with Fletcher Residential and others, as it appears, and it is a fact, that KiwiBuild relies heavily on developers to build the homes the government promised. They also use publicly owned land to build KiwiBuild homes, most to be sold to private buyers, via agents, and that is nothing different to asset selling, stuff that Labour blamed the Nats of, while they can do the same now, without ‘issues’, selling publicly owned land to private buyers and developers.

    Where is the outrage on TDB, I ask, where is it after all?

    John take them to COURT, please, I have found that is the ONLY real solution to deal with state abuse in this country. While we hope the state of ‘the Crown’ acts in our interest in a beneficial manner, often this is not the case (wrongful imprisonment, prosecuting WINZ beneficiaries for alleged ‘fraud’, and so much more), they rather use the taxpayer funded Crown Law experts to deny the citizens their rights.

    This is another case of state abuse, Twyford trying to present himself as the Knight of Honour, while he is really shafting those affected by an illegal testing regime and unlawful evictions and the likes, based on illegal practices.

    Twyford should hang his head in shame, but once in charge as Minister, shame and accountability take on a new meaning to any former opposition politician. Hypocrite is the fitting word, disgrace a description of the end result.

    It is time to take the bastards to COURT for the law breaches, same as MSD should be taken to court for the BS they presented:

  9. Is there a way to bring back or to put in a “written” AotearoaNZ Republica Constitution in place, with the Treason Act intact, where Ministers can be hung drawn & quartered or alternatively, meet the guillotine! I’m happy to volunteer a few days a week to operate the “Blade!”
