As readers of The Daily Blog will be aware, Netsafe recently contacted The Daily Blog and requested we secretly censor political content on The Daily Blog because a complaint had been made regarding that content under this ridiculous new Harmful Digital Communications law.
In no uncertain terms, I told Netsafe where they could go…
I have to be honest with you all, when the Harmful Digital Communications Act passed, I didn’t take a hell of a lot of notice of the fine print.
On the surface, the Act seemed reasonable. Human beings have a terrible ability to be cruel to one another and when they can be anonymous online that ability manages to become infinite, so I like many NZers probably nodded in agreement at legislation to combat online bullying in a cultural landscape that includes social media.
Oh how wrong was I.
Two days ago I was contacted by Netsafe who requested that under the powers given them from the Harmful Digital Communications Act that I censor The Daily Blog.
It gets so much worse than that though.
Not only am I not allowed to tell you, the readership of The Daily Blog, that I have been contacted by Netsafe to censor the blog, I am not allowed to tell you the content they wish to censor and I am not allowed to tell you if the blog has been censored.
Over the last 48 hours I have been shocked to learn the huge powers that have been handed over to a jumped up NGO who is merely deputised by the Ministry of Justice to manage the Harmful Digital Communications Act.
This law was effectively set up to stop teenagers bullying each other on bloody Facebook, what the hell are they doing trying to censor a political blog?
If The Daily Blog has published something that is a falsehood about you as an individual you have the right to contact me as the editor and request a right of reply and if we have over stepped the mark, an apology from the blog – failing that, you can always sue us for defamation.
I’ve been in this game since 1995, and in my 23 years (despite being banned from Radio NZ for life for supposedly defaming John Key), I’ve never been sued for defamation. I know the law, I sail pretty close to it at times, but I don’t over step it and I’ve got almost a quarter of a century of experience to back that up.
We have reviewed the blogs that Netsafe have asked to be censored and there is NOTHING defamatory in those blogs. If NZers knew what blogs Netsafe wanted censored, there would be outrage at the obvious political influences at work here.
Netsafe demanded that I respond within 48 hours as to whether or not I would comply with their requests for censorship, so let me respond publicly to Netsafe.
You can censor The Daily Blog the day you take the keyboard from my cold dead hands. The content you have asked to be censored is not defamatory and allowing secret censorship of political blogs is the most dangerous and disturbing part of your powers.

My advice to Netsafe is that they pause, take a long deep breath and consider the Public backlash at this type of censorship. You were given these powers to stop cyber bullying, you sure as Christ weren’t given them to censor political blogs. This is an outrageous abuse of power and I won’t acquiesce to it.
Any incoming new Government in September has to urgently check the powers that have been given Netsafe, because I can’t imagine anyone who voted for the Harmful Digital Communications Act thought for one second it would be used against legitimate political comment online.
If Netsafe continue this action against The Daily Blog, I will ensure you our readers know about it.

Netsafe contacted me with the following veiled threat…
…so because I wasn’t prepared to be silent about their request to censor The Daily Blog, they are stepping aside to allow the complaint to proceed. Effectively Netsafe are insinuating that because I refused their request for confidentiality and refused to participate in their Kangaroo Court, they will allow the complaint through without any of their supposed moderation of the process. So while they might agree the complaint is bullshit, because I wouldn’t play their game and embarrassed them by going public the complaint can go ahead without their moderation, which when you consider this is a Government backed agency is a remarkable position to take.
The last paragraph I find particularly chilling. Netsafe are promising that they will come after Political Blogs and even the mainstream media as a State backed censor. Remember this bloody legislation was sold to the public as a way to stop teenagers from bullying each other on Facebook, how has Netsafe’s scope gone from a genuine problem like cyber bullying to State backed Censor?
How the hell has this all occurred without any of us noticing?
If Netsafe come to my door again asking for secret censorship, I’ll tell them what I told them last time, you can censor The Daily Blog the day you take the keyboard from my cold dead hands.
If the complainant attempts to take me to the District Court I will ensure everyone knows what the material is and ask for you all to spread it as far and as wide as you can.
This ridiculous new censorship law might be able to shut down The Daily Blog or see me imprisoned until I comply with a take down notice, but it sure as fuck can’t stop all of you spreading the material into every single corner of the internet.

Whoever laid the complaint (and I can guess as to motivation) may find that the item objected to gains a wider audience than s/he ever imagined.
As for the reference to “making an application to the district Court” – I view that as a clumsy attempt by an inexperienced NGO to “flex it’s muscle”.
It is not typical of comments by the Human Rights Commission, Race Relations Conciliator, et al.

If I was to hazard a guess about who was the complainant in this censoring process I would look at who has the most to gain from these actions, and who has a reputation for trying to silence any critics. This would suggest zionist/Israeli operatives,the U.S Empire operatives,or agencies of the N.Z Govt.,or all three.I personally would welcome the opportunity to meet any of them in court.

The HDCA was set up as a cover for it’s intended purpose, that of censoring alternative perspective through media. NZ has been mislead as to it’s true intention. NZers have been fed (yet another) lie. Is that an offence in itself?
Who is the complainant? If things begin to turn vicious and it seems it’s very likely to, the complainant should be identified.
Censorship of media, regardless of it’s political leaning, is a step further towards a very dark deep state, something which will have serious ramifications throughout (particularly alternative) media in general.

Good onya Martyn. Censorship is the First Resort of Tyrants. That’s why Freedom of Speech is the First Amendment to the US Constitution.
Without knowing anything about the actual matter at hand, perhaps the best procedure is to encrypt a complete set of all of the relevant materials and post them to several locations from which they cannot be deleted. Then entrust the keys to this material to an absolutely trustworthy person known only to yourself, and never revealed, who will publish the keys anonymously should anything untoward ever happen to you. This is more or less how the “WikiLeaks Insurance Policy” works.
I’m sure Kim Dotcom can advise you on the technical details.

Just as exercise in whether the situations that they refer to has changed over time.
Of course, these would be randomly chosen articles, we trust TDB not to select them for any particular content that they might contain.
Wouldn’t the proper channel for making a complaint of this kind, in this instance be to the Press Council??? Standard procedure is for a complainant to contact the paper, blog-site etc first, asking for a retraction, apology, review etc, and if not satisfied with the response can then proceed by making a formal complaint with the Press Council. I’ve done it, so know the process. The Press Council whilst having no legal powers to litigate a defamation case etc does have the authority to uphold Press Guidelines which they deem to have been breached. That’s the real catch here, when content is being asked to be removed, outside the bounds of standard press complaints procedures. If the complainant requests for a removal / gag order via the courts, firstly they will have to prove the legitimacy of their case, and prove where exactly you have breached ethical Press standards. People with legal eyes, need to look through the Harmful Digital Communications Act, to see exactly where it is being manipulated to achieve censorship, as opposed to placing legal obligations onto those who bully, manipulate and attack others with an intent to harm via digital technology. They seem worlds apart to me….

This morning (ANZAC day) thousands of Kiwis are recognising the ultimate sacrifice made by others.
Rightly or wrongly, many of those who left these shores and never returned thought they were defending some notion of “democracy”.
How does that sacrifice look now, when legislation is enacted and employed to silence people in this manner??
That “sacrifice” was not asked for to be made for democracy, freedom of speech and the rule of law, it was asked to be made for protecting the interests of the powerful and wealthy elite, if you have not understood this yet.

Many are worried about all the detailed data now is being stored on a “cloud based system” that is known to be not safe and is prone to frequent hacking of their details bank and insurance data also.

Anzac Day Revisited
The powerless citizens of New Zealand drummed up by our Parliaments, have shouldered their rucksacks and rifles over the years and marched off to many distant war zones.
From Crimea to Afghanistan. “To make New Zealand a safer place in which to live”.
Anzac day is basically a celebration of our sad losses. Turkey having given us the hiding of our lives. Not to mention bloody Casino or Crete or Vietnam and many other battlefields.
Clearly, the time has come that should our Parliament wish to have a war somewhere, it should send the Politicians under the leadership of the Prime Minister.
The pollies salaries would be stepped down to the level of foot soldiers. For surely, they would not wish to get better conditions than the wretches who usually bear the brunt of War.
In the meantime, while the Prime Minister and his cohorts are overseas, we citizens could get on with the simple matter of building houses. A task that is sadly too difficult for our current Government.
We could also get on with bringing Equality, Prosperity and Self Esteem to the hundreds of thousands of Kiwis who do not have Trusts and Tax Havens and other huge handouts the wealthy continuously receive and accumulate.
We could also levy the very nice Australian Banks and Corporations who make $billions of Taxless income from our nice Kiwi Population.
For sad to say, our Government is too shy to ask for a fair deal from the wealthy Foreigners. Bill English appears to have a kind of Paralysis. So he taxes the poor workers and lower middle class. And piles on GST. He rates young New Zealanders very lowly. And pushes up the cost of energy with all his muscle. He thinks his various homes should be paid for by dumb New Zealanders. It is part of his “Shy man makes good” project.

Martyn this is really scary.
I remember commenting a few weeks ago about this censorship threat on another post when you informed us about Netsafes threats regarding a complaint that was laid.
I thought our right to free speech was enshrined in law.
I was wrong.
It would seem that the Human rights act and the Bill of rights are weak in enforcing freedom of expression and are open to abuse allowing the government to enact laws that can breach those rights ,in this case the HDCA.

This stinks of political interference and by allowing this we are being dictated to by an increasingly authoritarian regime that wants to silence political debate that it does not agree with and passing law that is deceptive about its true intentions to censor the truth.
We have been heading in this direction since John Key allowed foreign and domestic interference with how the state conducts itself with recently passed legislation on surveillance and spying.
A new government when elected must act in changing this law and strengthening our right to free speech and expression because it’s the weakness in the current law that allows evil regimes like this one to subvert our democratic rights.

So this is the same here in NZ too.
Top NSA Whistleblower William Binney told Sean Hannity on Monday the NSA is spying on everyone in America without warrants, which would include Donald Trump, and they’re keeping records of all our communications going back 5 to 10 years.
Note, this interview came out before the recent Wikileaks which back all of this up in spades.
