The 5 Eyes have won – American jurisdiction into cyberspace has been established.

Kim Dotcom is to be extradited to America where, without his wealth, he will face the full force of the State. He will appeal this afternoon.

The schadenfreude being displayed by so many on Twitter at Dotcom being renditioned to America is ugly.

NZ – a CIA client state – has done the dirty work for America and allowed corporate Hollywood the ability to claim sovereignty online.

    Perhaps a little off-topic but the disquieting thing about the Internet that I’ve never been able to shake is the notion that something so good will hurt all the more when it’s taken away for us.

    In the wrong hands the Internet is a formidable control mechanism and we should never have gone beyond the point of knowing we could still function without it.

    This may sound old fashioned, and call me so if you must, but I’m a bit of a fan of a simple, shortwave radio system interconnected to others . Like , you know ? Ten-Four Good Buddy and all that.

      • Not a lot of smarts in the Labour Party these days, since the Neo Liberal take over of the Labour Party in the 1980’s they have struggled to define who they actually are and who they represent.

        Hence the voter is confused what the Labour Party actually stands for, hence the missing 1.0 million voters. Labour under Roger Douglas abandoned it’s traditional support base and literally f****d them over. It was basically a reverse takeover by the ACT Party, Labour has never really recovered and still has Neo Liberals like Phil Goff within its ranks.

  5. This was a political, not a judicial decision, with the NZ government acting on behalf of the complainant, the US government in court.

    Like him or not, Kim Dotcom was obviously set up from day one, when he was allowed into NZ, despite some questions about his past.

    Granting him and his family residency was the first step in FJK feeding KDC to the greedy US corporate wolves, who were after him and knew NZ was an easy place to get him! The traitor FJK complied willingly.

    A very bad day for the NZ judiciary system. A shocking day for ordinary vulnerable NZ citizens and residents, without the means to put up a challenge should they be picked off and sold out to a foreign power, by one very corrupt and evil man.

      • The only thing concerning me mightily about the judgement is the worry that the decision might be overturned on appeal. I live in hopes that the appellate judiciary have been well and truly ‘bought’and corrupted by the political establishment.

        My regret is that the judge in the Hager case was not similarly ‘bought’.

        And no I am not a right wing troll who ‘down votes’ comments. I first can’t be bothered and secondly I am a Labour voter,although I often wonder why on reading some of the comments on this site.

    Kim DC. is a resident of New Zealand with the civil rights and protection that go with that, and New Zealand please don’t give me the knee jerk response that I expect will ensue.

    This is the TPPA at work and the key problem here is that the ilk of MGM et al won this skirmish, but not the fight.

    Kim Dotcom and his fellow ” scoundrels ???(,? I don’t think they are) need a fair deal on this one. That can only be done , I believe in the High Court.

  16. Come on, it is not yet over, the justice system allows appeals, and Kim Dotcom already announced that he will appeal. There are many questions though. Extradition hearings only need to establish that there are valid reasons for extraditing a person, as valid charges deserve to be answered. There are at the same times questions of law, which Kim’s lawyers have already mentioned, not going into detail. So a District Court Judge may have his reasons and considerations, they can though be challenged. That will happen.

    I think that honestly Kim Dotcom’s chances are not great, but there is still a chance that a High Court will overrule the District Court decision, and things can move from there.

    My view of Kim Dotcom is not a favourable one, he is primarily only interested in his own fate and future, and a fair few have attested to this. But he does at the same time deserve justice. The raid on his mansion years ago was an appalling breach of justice, in my view, an abuse of executive powers, but we were told later that most of the actions were “justified” (courts ruled).

    This is not primarily about the Five Eyes network, that is a construct, it is about justice, ok, but the Five Eyes are having other things to answer to, which they avoid doing, which is assisted by this government.

    Obfuscation, dishonesty, concealing the truth and outright lies are what we have learned this government to engage in. So, yes, many questions need answering, more research needs to be done, but I would be careful to mix things up, as Kim Dotcom’s “issues” are commercial interest based ones, which Hollywood powers are not going to give up. And the US prosecution is on their side, as what Hollywood produces and has in copyright, that is to them of “national interest”, similar to what Key and Co consider the local film industry and some other activities to be.

    And as that is so, forget trying to get any revelations per OIA or so, as that will not be covered by the Act.

    I look forward to more court hearings next year, and we will see who will come out on top. By the way, how are the other accused going to proceed? I heard they are not acting alongside Dotcom, as they have kind of broken away, and pursue their own goals now.

    The are too many murky aspects in the whole situation, I wish we would get more info and transparency, but it is up to the courts to look at what is important, and what is not.

    • You are dead wrong about Kim. He is very much concerned about others than himself and this is evident if you are aware and have studied him with an open mind. Look again at the MOMENT OF TRUTH transcript and get familiar with the facts and the truths about what was said that night and who funded it. An eye opening event and it went right over most peoples heads. An extremely important event gathering of brilliant minds and caring people and it was misjudged and misrepresented.
      Kim is a very compassionate and honest man and clearly you, are like many others, and believe nonsense about him.

      The legal system is what is a disappointment and some judges should be put out to pasture and retire which would be in everyone’ best interest.

      • BLAKE – I have happened to have met the man a few years ago, at a public event, and he came across as a somewhat arrogant person, able to chat about stuff, but disclosing little about himself. He has been reported on, has spoken in the odd interview with Campbell Live and others, where he is good at presenting himself, and trivialising his past.

        There were stories of trades- and security persons he hired, to do work for him, who did not get paid for long times. He declared having lack of funds and drove around in flash cars, and spending up on personal matters, same as on his many legal representatives.

        Kim Dotcom appears to have access to funds from his new business, and continues to employ top lawyers working on his case. He donated funds to MANA to run the last election campaign, but when asked whether he would perhaps help unemployed Maori up North to learn about IT skills and help them get work, he only spoke in ambiguous terms and would not commit to anything.

        And some producers copyright was breached, technically by users of MEGA Upload, which was though also encouraged by the people behind that business, including Kim as it seems.

        So some persons that made small scale movies and produced music and so, they missed out on earnings, because their stuff appeared free on the internet forum or service of MEGA Upload.

        Tell me where Kim Dotcom did offer funds or other support for the poor, the homeless, the unemployed Maori up North, or whosoever, please. All I have noted is words with little or no action coming from Kim Dotcom, but all his energy and money flows into his own business and legal expenses, to defend himself, also avoiding extradition. The US may have questionable reasons with their legal actions, but so does Mr Dotcom, I fear.

        Why would people go around collecting money for the hiring of the hall, if it was all paid for? An earlier, different meeting, at which Kim Dotcom attended, had people go around with buckets to gather donations from the attending crowd.

  17. Always been a bit conflicted about Dotcom. I am totally against this whole business of buying your way into this country, so if I’d have had my way, back when, he never would have made it here.
    Being as he did, I then have to think about my opinion from there. I can’t work out how another country can have jurisdiction over someone who is committed of a crime by another country, but not in that country. The world of technology is changing fast and I wonder if the old rules can apply to the new game.
    I believe artists should be able to gain from their own work, but it seems to work differently for say painters than musicians, painters do not receive a royalty whenever one of their paintings onsell, do they, yet in some way, the painting is still their intellectual property.
    It also strikes me that copyright is more of a civil law and wonder how the heck the FBI got in on it all.
    Most of all, I am not at all sure that Dotcom will receive a fair trial in the USA. That probably outweighs any other view I have about the whole thing.

  23. My sympathies are with Kim dotcom. He seems to be a rare talent who perhaps was a bit wayward but he does not deserve this. I agree with one of the contributors above the whole process has humanised him and I think NZ would have gained a lot from having him on board. It is clearly the USA that is the problem here, just as they are the problem in the middle East, In Ukraine, In Asia, and pretty much everywhere. Why is this? Because they think they are exceptional people who deserve to control the world and rape it for financial gain either by “legal action”, Trade agreements”, or military adventures. Who needs the bastards?

    • I would agree that the whole process has made Kim Dotcom more humane, as he is at the end of the stick, after years of being able to live it up and enjoying privilege and riches.

      He is now learning, after many trials, also losing his wife, that life can be difficult and full of challenges. And he has a massive challenge in the US seeking his extradition, to face trial in the US, where his chances may not be that great, no matter whether he is right or wrong in his own actions and arguments.

        And as I and others have said… the issue is more about our sovereign laws being made subservient to that of a foreign powers interpretation of law on our own soil.

        Particularly as we have a PM who has certain interests in maintaining that foreign powers vested interests aka the Hollywood movie industry that drew up the terms of TTPA to be ratified by Congress.

        It could of been anyone but in this case it was Dotcom that challenged the monopoly of that industry thus the terms of the TTPA , as such Dotcom and his co defendants have been made the fall guys for geo political reasons.

        The issue is less Dotcoms challenging that monopoly but more about the issue and the question of our own sovereign laws – and just how far Key and others like him are prepared to go to make our sovereign laws subservient to geo political and foreign vested interest groups.

        And this latest ruling is an indication of that.

    How can New Zealanders standby and let this happen, we are like ostriches with our heads in the sand.

    The TPPA ain’t a Free Trade Agreement it is exactly the opposite, it protects companies like Monsanto from competition and protects its long term revenue streams.
