Why every Kiwi should celebrate High Court ruling on mandates
A High Court challenge questioning the legality of Covid-19 vaccination mandates for Police and Defence Force employees has been upheld, with the court determining that the government mandate is an unjustified incursion on the Bill of Rights.
The Dumb Lives Matter Protestors & the never vaxxers think this is an enormous moral, political and legal win for them when in reality it’s proof positive the system is actually working.
As a post-marxist anarchist environmental socialist I detest the State up in my grills as much as the next free individual, but I agree with this curtailing of my civil liberties for the public good.
That extraordinary power over us by the State in the middle of pandemic MUST be challenged every day of the week, and when that mandate is too onerous, the legal side swings into action and pushes back on State power.
This is great news for all of us, it’s the moment when the law says that the State’s caution no longer trumps the individual’s rights.
It doesn’t mean that the mandates weren’t legal or necessary in the past, it just means that Omicron is such a weaker variant than the previous variants that it no longer warrants the emergency level powers over us as individuals.
That’s evidence of our system working!
Good. There was always a point when the mandates would come down, so their removal isn’t a loss for the Government.
Critics seem to believe that Labour want to keep the mandates for nefarious reasons which is bullshit. The Government desperately needs the economy to get back on track and will drop the mandates as soon as they can.
This High Court win is a win for everyone.

The mandates were justifiable when applied to border workers and when the government was pursuing the elimination strategy. From the day the eliminations strategy was abandoned and Covid became endemic their relevance to public health has been negligible. Their only effect was to divide New Zealanders and set them quarreling amongst themselves on the false presumption that the non-vaccinated were the threat to the rest of us, rather than Covid itself.
Jacinda could take note of the court ruling, see sense and bring a swift end to nation-wide protests. But it probably suits her to have that distraction present just in case the Omicron outbreak gets messy and the hospital system fails to cope under the pressure.
Its an illusion. Let the tyrants run wild and then reign them in when over 90% of what they wanted is achieved. But reign them in we surely have – look everybody – the system is still working. We’ve reigned them in. Yeah right.
Unlike you, Martyn, I believe in government, but this government, like most Western governments, now days, is corrupt to the core. The WEF are having a field day.
Soooo why haven’t they removed mandates for everyone already?
They haven’t been justified for some time, it’s just that then, anyone saying so was an evil death capitalist.
Never mind we were told vax mandates were only to get us to 90% double vaxed, then they kept them anyway, and now talk of restrictions for flu season.
It shouldn’t have to take a legal case to get a government to do what is right.
Imagine every citizen only doing the right things if they were taken to court :The courts are there to enforce a legal bottom line, if you are crossing that line you’ve missed a bunch of chances to act appropriately.
Is it ok now that an antivax nurse can get infected with the delta variant go to work and infect my sick granny?
I thought that Health and Safety, a National emergency like a Pandemic or in a state of war would trump/over-ride bill of rights.
Martin – the ruling only applies to the Police and Military – it does not apply to the hundreds of workers who have or are about to lose their jobs in both retail and the service industry. Those mandates were made under HSWA and not a Government mandate. That is unfair and it seems from the legal opinion we have to date is the HSWA has more power than a Govt mandate.
I believe the Govt will appeal this ruling which is wrong they should do away with vaccine mandates altogether now given the spread of Omicron in the community – what purpose are they now other than punitive and giving the wanking protesters in Wellington oxygen to their bullshit protest.

So our protectors the NZ Police and our military will now potentially be spreaders not protectors, spreaders
