  1. A very moving account. How can such a thing happen in such a supposedly enlightened country? Yet it does, time and time again. Such miscarriages of justice will be even more frequent if pending legislation is passed.

  2. A disturbing read.
    Common sense and logic don’t seem to apply.
    It would be wrong to include poor police work in alongside that, as that is pretty much a given all too often.
    I fail to understand the belief that the trauma of the trial , and the revisiting of the assault, is only felt by the claimant, and not by the accused…..especially when they are innocent of the accusations.

    1. @Brian Green – a disturbing read indeed Brian and now Jan Logie’s sexual violence bill aims to essentially make all men (it is normally men) guilty of sexual crimes based on an allegation only. I applaud Samira Taghavi and her female lawyer colleagues like Marie Dyhrberg QC for fighting against this bill and for exposing the injustice of it all.

  3. I personally know someone who was the victim of false allegations of this nature. Only he decided to plead guilty as they told him that he would guaranteed home detention if he did, and he wanted to just get it over with. Unfortunately, he was told by Probation that he couldn’t serve it at where he lived, so in the end, a family member offered to let him stay at their house, which was good. However he lost his house and had to go somewhere else after his time was over. Fortunately, the person that accused him withdrew their allegations, so everything was dropped. Still didn’t get his house back though. Was completely screwed over.

  4. This breaks my heart. Literally breaks my heart in a million pieces. Not only for Brett and his wife having gone through this nightmare, which is all too familiar, but because the justice system in NZ is so broken, so blind, so corrupt that innocent men are being punished while false accusors go free (even after being proven false!)
    I believe the same thing to be happening in the Foster case. It’s not right. There should be public outcry. False accusations are destroying lives and families …and the system who stands for justice are failing on a grand scale.

  5. This is a terrible thing to have happened to an innocent man and his family, and the effects may impact upon them forever. Also, mud sticks, even when, in the passage of time, the facts are forgotten.

    I don’t have a clear understanding of what these Green persons are planning, or are trying to achieve, and would appreciate having one. In the UK, a sexual accusation, without proof or the playing out of legal processes, can be recorded on a police file, and this too can have a prejudicial effect against an innocent person without the issue having ever been progressed to any sort of conclusion.

    Given the current destabilising fluidity and exploitation of sex and gender issues – at the very least, financial compensation for victims like this family, should be made available by the crown. There must also be penalties against false accusers, regardless of how or why they’ve done it. I asked a young woman why she made something up about somebody and she replied that she didn’t know. This may have been true, but it is not good enough. Psychopaths and their ilk can be very clever, and wreak colossal damage without any remorse.
