Nearly 40,000 New Zealanders could soon receive debt letters from the Ministry of Social Development after new legislation allows the Government to recover welfare payments from people whose ACC claims were later approved. The Government today passed legislation entrenching nearly 40,000 people, including many sexual abuse and abuse in state care survivors in debt.
Pushing survivors of sexual abuse, survivors of abuse in care and injured people into debt is cruel and inhumane,” said Green Party spokesperson for social development Ricardo Menéndez March.
“The Government had every opportunity to not entrench an unlawful policy that has harmed survivors of abuse. They were asked to exempt them, but today they refused.
“Just over a year ago, the Government stood in Parliament and apologised to survivors of abuse in state care. Today they passed a law that will continue to harm many of those same survivors. That is a betrayal.
Retrospective legislation overrides High Court ruling
“The High Court ruled that what MSD was doing was wrong. Instead of accepting that ruling, the Government rushed through retrospective legislation to override it, ignoring the warnings of lawyers, health professionals, and community organisations.
“These are not people who were ‘double-dipping.’ They are members of our community who relied on welfare support in good faith while waiting months or years for ACC to accept their claims. The system failed them, and now the Government is punishing them for it.
“Survivors of sexual abuse and survivors of abuse in care often have to go through long, retraumatising processes to access support from ACC while on welfare.
“The delays they face only add to the debt that is slapped on them once they finally receive support for rehabilitation. This is opposite to the claims from the Government that this bill is about equity.
“The Greens voted against this bill because we refuse to be part of a Parliament that punishes people for being injured, for being poor, or for surviving abuse,” said Menéndez March.

Many of those 40,000 would have used that welfare in desperation, they wouldn’t have believed they were paying it back!
Many are sensitive claims meaning they were on welfare after being abused.

Those debt letters are going out in September, 40,000 startled Kiwis are about to find out they owe MSD and if Labour had been dumb enough to vote for it, National would have their perfect patsy set up.

They argued there must be discretion from MSD to write off debt if pursuing it would cause hardship.
They also demanded that sensitive claims be left out of it altogether.
When the debt letters hit letterboxes in September, tens of thousands of the saddest tales every told will swamp the media and National won’t be able to say, ‘but Labour voted for it too’, as a defence.
In fact Labour will be able to argue this is why their amendment should have been adopted because there are many who will be suffocated by this debt.
Why the welfare payments were originally provided

They all took that welfare money in good faith, they didn’t know they would have to pay it back!
These are Kiwis who were sick, or injured or had been victimised by terrible crimes. They were waiting for ACC to process their claims and while they were waiting, they were given MSD Welfare as a solution to ACC taking so long to process the claims.
NOW National are telling those 40,000 Kiwis that the welfare paid to them by MSD while they were waiting for their ACC claim to be processed must be paid back!
Many of those 40,000 were on the bones of their arse, they took that welfare believing it was the solution to ACC process times being so long, they didn’t know they would have to pay it back!

Labour can hold up their amendment and tell those 40,000 that a Labour led Government would save them and give those 40,000 a real reason to vote.

Is it alright to double dip at the taxpayers expense if you are poor? The double dipping politicians (think English and Luxon etc.) dont think so. The type of people who work in MSD and would begrudge a thin blanket and a loaf of bread to a hungry child also dont think so. If these particular double dippers used their good fortune to buy a holiday home at Taupo or spent a couple of weeks on a Greek island then yes, make the buggers pay it back. I’m guessing that wasn’t the case and that the money was used in the grim game of survival playing out every day in our uncaring society. Leave them alone.
