    This is the beginning of fairness in the work place. How many missed that money and used a credit card for dental or automotive costs?

    It disheartens me when I see this type of “work around” going on. I will always call it out,too.

  3. Well done Unite. Ridiculous that you should need to force this though. The law on this should leave no room for alternative interpretation. Should be: work on a public holiday gets you a day in lieu – end of. No arguing about what constitutes a ‘normal’ day of work.


  4. The right of workers to an alternative holiday when working on a public holiday has been strongly affirmed in an Employment Relations Authority decision against Wendco (NZ) Limited, the company that operates the Wendy’s stores in New Zealand.

    Wendy’s had been using an interpretation of the law that effectively prevented most of their employees from accessing their lawful entitlement. In Wendy’s case, this was using a rule that an employee had to have worked the previous three Mondays if they wanted to claim an alternative holiday for working a public holiday on a Monday.

    It was easy for managers to roster workers off one of those Mondays to stop them getting the entitlement.”

    This loophole must be tightened. It is a flagrant abuse of the law that Wendys and other companies have been allowed to get away with this rorting.

    My family will be avoiding Wendys in future.
