Thousands of police formal warnings set to be wiped due to improper protocol over several years

Thousands of formal warnings issued by police could be wiped from official records and compulsory training for all staff in the country has been introduced because police haven’t followed proper protocol for years, the Herald can reveal.

Prime Minister Christopher Luxon called the blunder “pretty sloppy”.

“They [police] need to complete the paperwork and do it the right way,” he told Newstalk ZB.

Luxon stopped short of saying the entire system should be scrapped but emphasised the need to follow proper process.

Relying on formal warnings during police vetting has been stopped nationwide because of the botch-up, and police are now inviting anyone who has concerns about a formal warning they’ve received to contact police and request a review of their records.

The issuing of possibly thousands of non-compliant formal warnings represents a major logistical and administrative bungle.

It also raises questions about whether people have missed out on jobs because police relied on dodgy and unlawfully issued warnings.

Deficiencies in the formal warning system were first identified in 2021, after a High Court judge found the way warnings were issued breached the law.

Central to the court’s ruling was that police didn’t understand that for a formal warning to be issued a suspect must unequivocally accept responsibility for their offending, and there must be sufficient evidence to prove the offence.

After that ruling, police said they’d review and update their policies.

However, the Herald has learned that four years since flaws were first identified, significant issues remain.

A review conducted last year found that of a sample of 467 warnings issued between 2019 and 2024, only 171 or 37% were found to be compliant.

That means almost two-thirds or 63% were issued unlawfully.

When the cops came after me, they told every bank and every lender in the country I was Rawshark which shredded my credit rating as a byproduct of their lies.

How many people missed out ion jobs because the Police were issuing unlawful formal warnings?

If I’ve said it once, I’ll say it again billion times more, the NZ State and the NZ Police are the biggest abusers of civil liberties in NZ!

The Courts have ruled against these abuses of power, but this again boils down to the lack of oversight to Police power, a lack we have seen most obviously with the McSkimmings scandal.

At some point Kiwi, your weird authority worship of the cops is going to have to be challenged.

WHY are you so opposed to forcing oversight onto the cops?

My assumption is that many of you have simply carried the original white settler mentality towards the cops into the present day.

The NZ Police came out of the ‘mounted constabulary’ who were created by white settlers to beat the bejesus out of Māori on the edges of the settlement. The unspoken contract between the mounted constabulary and the white settlers was that the white settlers would turn a blind eye to any heavy handed tactics used by the mounted constabulary so that the white settlers could feel safe.

This unspoken contract has been bred into the modern and we refuse point blank to have any oversight to the cop.

The IPCA is underfunded and doesn’t have the legal capacity to produce true oversight of Police power.

At some point, this cultural hangover of spineless acquiescence to the police must be challenged if we are to move forward.

It’s funny how Tamatha Paul was attacked earlier this year for daring to suggest that not everyone in the community trusted cops, after McSkimming’s those voices who attacked her are all very quiet now aren’t they?
