Last-minute amendment to gang patch legislation under scrutiny
A last-minute amendment to the Government’s gang patch ban legislation has prompted concern from legal experts.
The Conversation reported that a person convicted of publicly displaying gang insignia under the new legislation three times in five years would also be banned from possessing gang insignia for five years – and banned from having insignia in their homes.
“In essence, it will make it illegal for repeat offenders to live in the same place as gang insignia is displayed – regardless of whether the insignia is theirs or belongs to someone else on the property,” it reported.
Police would be able to apply for warrants to search homes for insignia.
Last month, the New Zealand Law Society wrote an open letter to Justice Minister Paul Goldsmith, criticising the move.
“The Law Society believes this is an incursion into private life that is not justified on the basis of the evidence available, and raises Bill of Rights and rule of law concerns,” the society said.
Let’s talk about why the new crackdown against organised crime has occurred and the dangerous new Police State Powers that National have secretly given the cops that will inevitably be used against environmental protest groups or Māori activists.
So firstly – why is this happening…
Entire Christchurch Comancheros gang chapter arrested; police seize guns, cash, drugs
-
- Every patched member of the Comancheros gang in Christchurch arrested
- Twenty-one people now arrested
- Police seize cash, guns, drugs, and assets in remarkable crackdown
- Police allege the gang organised for drugs and cash to be relayed between Auckland and Christchurch every few weeks
…now even The Daily Blog‘s most critical critics will acknowledge that TDB identified the threat of the 501s into the NZ underworld and the impacts that was happening well before any other NZ Media.
To recap: The NZ underworld has faced an existential threat unlike any other in its history. Thousands of hardened Australian criminals with contacts to an Australian criminal culture that is and always has been, far more sophisticated and far more violent have been forcibly renditioned to NZ, a country where very few of them have any contact with since leaving NZ as children.
Now you can argue successfully, that these 501s have lived most of their lives in Australia, and if they have become criminals, well that’s on Australia, but they force these 501s out of the country back to NZ.
NZ Politicians have spent decades frightening Kiwis with terrible stories about our domestic gangs, the truth is our gangs are far less dangerous than the sophisticated Australian criminal fraternity.
The moment the 501s realised how soft the domestic gangs were, they have started stand over tactics to take over the meth trade, THIS is what has driven the shootings, the murders, the drive by shootings and the sudden ramping up of guns and recruits as the 501s have launched a take over campaign against domestic gangs.
These new 501 syndicates use South American cartel contacts and Chinese shadow banking to import cheaper and more pure meth than the domestic gangs in NZ can bring in via their Triad links.
The South American cartels are trained in counter intelligence methods so bring a sophistication and uber violence to anything they touch and because the demand for meth is so high in NZ, the price is the key.
A point of meth in America is $5, in NZ it’s $100. That price difference makes us a market the Cartels want to gain access to.
So why the sudden crack down, what happened and changed?
I put it down to Chippy when he was Police Minister.
We had a situation in NZ while Chris Hipkins was Police Minister where the GCSB and SIS were picking up international communications between 501 syndicates and cartels, but this intelligence WAS NOT being sent to domestic cops in NZ to action, instead that intel was going up the intelligence chain of command to the NSA and our Australian spy counterparts.
It led to a situation where the Gang Intelligence Unit was a joke…
Gang Intelligence Centre leadership concerns revealed in document release
New Zealand’s Gang Intelligence Centre has been blighted by poor leadership and has been struggling to reduce the harm caused by organised crime.
Multiple sources RNZ has talked to said the leadership of the Gang Intelligence Centre was “clueless”, and one person said it was run by a bunch of buffoons.
Leadership were said to have no understanding of the gang environment, which in turn meant the centre was failing to have an impact on the harm being caused by gangs.
…I suspect Chippy read the riot act to the intelligence apparatus in NZ that if we had intel between the 501s and their cartels, then that intelligence should be shared with NZ Police so that it could be actionable, rather than just taking notes to hand over to our Big Brother spy agencies.
I suspect that the threat to National interests was satisfied to allow the GCSB and the SIS to share that intelligence with domestic police on 2 points”
The first is the genuine danger of allowing Cartels to gain a foothold in NZ and the second is the introduction of Chinese shadow mirror banking that allows the transfer of huge amounts of cash to facilitate the organised crime banking needs.
Cartels and Chinese Shadow mirror banking are threats to national security and the intelligence agencies are now providing domestic NZ police with the intel where they can make giant arrests like they have.
The expose in the Financial Times at how wide spread Chinese shadow banking for criminal organisations has become also notes Auckland in the global chain of this criminal empire.

So we should be grateful for a massive crack down on the 501s because they are a real destabilising influence on NZ, especially as they have been empowered by Chinese mirror shadow banking, however National are focused on the street gangs like Mongrel Mob and Black Power which don’t pose the threat the 501s do and that is allowing for secret legislation that isn’t being scrutinised that give cops extraordinary Police State powers…
Last-minute gang law changes ban insignia in homes and widen police search powers
At the 11th hour, and after the public consultation process had closed, the Government extended its gangs bill to give police far-reaching powers to arrest people for insignia kept in their home
A late addition to proposed gang laws will give police broad powers to search people’s homes in the name of stopping repeat offenders living under the same roof as gang patches or gang insignia.
The amendment, which technically regulates speech or expression in a person’s private residence, was added to the bill after the select committee process, meaning there hasn’t been the opportunity for experts, interested parties and the public to scrutinise the changes.
…this is such an outrageous abuse of power by the Police, it simply can not be allowed to stand.
The Law Commission is fucking scathing of this…
The open letter, sent by the society’s vice president, David Campbell, said the proposed law essentially set a new precedent for giving police regular access to people’s homes, distorted the reason for police to search people’s homes, and wasn’t relevant to the primary purpose of the Government’s public gang patch ban.
The society sent the letter to Goldsmith almost three weeks ago, but is yet to receive a response. In the meantime, the clock is ticking, as the Government moves forward with passing the two bills into law.
…allowing the cops unlimited access to your home because they suspect you have a banned gang patch INSIDE THE HOUSE is a fucking outrageous abuse of power and changes the whole point of search power forever!
Remember, the definition of a gang is 3 people working together to break the law, well that can be any environmental protest group can’t it?
The speed with which the cops will use these powers against people who it was never meant to be used against will bewilder us all.
There is a smart way to deal with organised crime, and then there is a really dumb way to deal with organised crime.
We are doing the really dumb way because this is NuZilind.
The Gang Ban Patch will be a joke.
It is setting up a situation where the Government will want some stupid over the top stunt to remove a gang patch from a gang Tangi.
Findings of the Royal Commission on Abuse in state care suggest that 80-90 percent of gang members were victims of abuse.
Let that fact sink in.
If you want to stop gang members, stop abusing children in state care FFS!

These CoC shitheads are aiming for a nasty prison state–private prisons of course, but paid for by taxpayers!
The new bone headed restrictive teaching curriculum will penalise those youngsters who arrive not ready to read at a good level–Reading Recovery and Teacher Aids have been defunded!–so basically there will be a layer of poor kids frustrated and humiliated until they are ready for bootcamp…
The Law Society is correct, and we should all oppose the authoritarian “snatch a patch” legislation. Martyn is right that such an approach could easily be extended to political and environmental activists–busted for a Greenpeace T–shirt…Dairy Farmers and sheep shaggers do not like Greens, Mr Hoggard of Act is a Farmer.
Labour’s gang control was to allow them to take charge of the roads when a member was taken to his funeral.
Labour law and order policy was very weak and imposed so many constraints on good policing it made the country unsafe for many. .
cant wait for the raid on national party head quaters to remove all their hate manifestos and ties ,caps and other national party gang clothing .
POLICE HEADQUARTERS AUCKLAND NEW ZEALAND 2024
Senior Sergeant Plod to detective Inspector Snoop.
‘Well sir we have good information that master Criminals are smuggling large amounts of Methamphetamine, heroin and cocaine through both the Port of Auckland through Cruise Ships, selling it for millions of dollars, and laundering the proceeds through Casinos.
‘We have identified I.M. Evilbastid and M.I. Wicked in these photos and believe if we get and execute search warrants on them we will discover incriminating evidence that we can use to take a huge amount of narcotics off the street.’
Snoop looks at photos. Shakes his head regretfully.
‘Well Plod, the immediate problem is that these people are all wearing expensive suits and driving sports cars. I happen to know that some of them are well connected members of Business communities.’
Plod
‘Well sir, we have to get arrest and conviction numbers up to show we are serious about crime.’
Snoop
‘Go on arresting people for displaying gang patches and plant drugs in their cars. If we have anything recovered from robberies put that in there too.’
‘Kill a few birds with one stone so to speak.’
Plod looks worred
‘Will that not reinforce the image of NZ police as racist sir?’
Snoop exasperated
‘Plod This is a post colonial country with a brown underclass. Of course it is fucking racist.’
‘So What?’
Later in Police Interrogation Room
‘All right Hemi – you are wearing a gang patch.’
Hemi
‘So are you. Yours is New Zealand Police.
And your gang is bigger and better armed than my gang.’
Thanks for this. But how about putting in a link to support your claim about the TDB and early recognition of the danger of 501s? Then those of us who are interested in the issue could read it.
Cheers.
