  1. This is where our rates money is going?

Cable Bay Vineyards ordered to pay $412k legal costs in protracted Waiheke Island noise case
    https://www.nzherald.co.nz/nz/cable-bay-vineyards-ordered-to-pay-412k-legal-costs-in-protracted-waiheke-island-noise-case/3ARXI2JTWAHI6SEVCI2JOVLFQE/

Councils first failed to enforce the noise, enabling provocative, anti neighbour behaviour, and after losing, will appeal.

This then creates a situation where people obtaining resource consents and ignoring the rules keep doing it, they know the council will support their bad bahaviour and appeal every time they lose.

By Auckland Council lawyers always appealing this then means the judges in environment court are reluctant to fine the council, as they know their ruling will always be appealed. But long term this creates a lack of responsibility in the council and a worst standard of living for Aucklanders.

Auckland Council has ballooned it’s debt from $106 million to $10.5 BILLION. Operating revenue was up 7 per cent to $3.8 billion. They are clueless, keep going into debt and Auckland is becoming a horrible place to live, with the focus on enabling poor behaviour.

Everyone loves their rates money, going to council private lawyers to help rowdy, F**k you to other businesses and people living in Waiheke!

Bet the cost of legal appeals are more than the costs to ratepayers and when is the council lawyers going to take responsibility and change instead of appeals?

    extract.

“The judge also took aim at the council, saying its “belated” enforcement action and “failure to act” contributed to an escalation in problems, adding time and cost.

The council’s “neglect of duty” resulted in enforcement orders being needed “for some quite egregious matters when it finally took action”.

“Earlier action by the council could have taken quite a lot of the heat out of the process, with significantly less cost to parties.

“For these reasons, I conclude the council failed in its duties and costs should therefore be awarded.”

Auckland Council is dysfunctional as seen by their debt going from low millions to now billions!

    • Why should neighbours put up with noise from others nearby earning a living and hopefully paying tax and providing work? For a long time those wishing to retire or move to lifestyle blocks in the country, and then proceed to complain about the workings of the money-earning
agricultural businesses that affected their preferred quality of life in sylvan surroundings.

      • Noise is a controlled activity in the city. Rowdy events will have clear conditions on that noise in their resource consent. Other businesses nearby may have other businesses like B&B’s or work in other areas, and they have the right to peace and enjoyment on their properties too.

As for country, it is ridiculous city people moving there and complaining about noisy animals etc which is outside of farmers control and what is to be expected. On the other hand recreational activities in rural areas that are noisy should be fully controlled.

Party goers should be expected to control themselves and their noise.

  2. First they get rid of School Certificate and Bursary for NCEA saying the big benefit is that they won’t fail anyone…

Now they are implementing a test that if failed, fails anyone from NCEA, who might be good at other things, like art, music, Te Reo and other languages, technology, etc

Not only that, up to 3/4 of students seem to be failing it! And it starts next year, after being very unsuccessful in trials. Why would you roll it out after Covid, screw kids up, even more?

Principals alarmed by low pass rates in NCEA literacy, numeracy tests trial
    https://www.newshub.co.nz/home/new-zealand/2022/09/principals-alarmed-by-low-pass-rates-in-ncea-literacy-numeracy-tests-trial.html

That is because the teaching system pushed by the education ministry, seems more interested in teaching woke crap in unproven ways than making sure that kids know the basics that practically every child could do, 30 years ago in NZ like writing and numeracy.

Keeping Kiwi kids out of tertiary, number 1, priority after Covid!

    • Probably trialled in the USA from which all our blessed policies flow. (That’s a lie Greywarbler, only 85.63% come from the US. You’d better learn up proper!) e&oe

  3. Not just this despicable practise, police photographing protestors is intimidating, and stops people having their democratic rights to protest as they are treated like criminals while having no crime.

  5. Interesting – Chris Finlayson being taken to task for statements said to be unverified by fact. Is nobody sure of anything in our political wash, are we all being hung out to dry?

The facts about base isolation at the Library
    Sep.8/22 with comments
    by Dr Jenny Condie

Former attorney general Chris Finlayson has today publicly (paywalled in the NZ Herald) made serious allegations against the professional reputations of a number of senior council staffers. He has implied that they failed to pursue a potential $65 million cost saving on the Te Matapihi central library strengthening project. The allegations form part of a complaint Mr Finlayson made to the Auditor General. Unfortunately Mr Finlayson tired of waiting for a response, and today took details of his accusations public….

…To understand these accusations that staff deliberately refused to investigate a potential cost saving of $65 million on the Te Matapihi project, we need to go back to the decision that was made by councillors. Five options for Te Matapihi went out for public consultation. Three of these options were to strengthen the building to low, medium and high resilience, the other two were options to build new. On 28 October 2020, councillors were to decide which option to go ahead with….

    (Detail from report)…
In other words they concluded that viscous dampers would deliver medium resilience and that the only technology that would deliver high resilience was base isolation.

Past MPs popping up and having another go outside opening hours, is not necessarioly bad but should it be countenanced in this case?

  6. Barbara Ehrenreich has just died aged 81 – never heard of her. I’m 80 and she had never heard of me either. But the difference is that she has been sparking on all cylinders for a long time. I have been sputtering along, successful despite all, but only in my own little
individual sphere to my own goals.

So when she was mentioned in https://thedailyblog.co.nz/2022/09/09/political-roundup-how-politics-got-captured-by-the-middle-class-and-why-its-a-problem/
I looked her up and will follow with more of her books if I can find used copies, and through the library system.

Being old and having various treatments and pills, with an aged father who is paying large amounts for a pill to keep him going, while he attempts to look after a younger wife with alzheimers, and neither does much to help people much younger (I’m talking of general public not family) who are struggling to live, I was interested in a book she has written about our bodies and attitudes to life and death.
    Natural Causes
An Epidemic of Wellness, the Certainty of Dying, and Killing Ourselves to Live Longer
    By Barbara Ehrenreich

    Summary:
Barbara Ehrenreich explores how we are killing ourselves to live longer, not better. A razor-sharp polemic which offers an entirely new understanding of our bodies, ourselves, and our place in the universe, NATURAL CAUSES describes how we over-prepare and worry way too much about what is inevitable. One by one, Ehrenreich topples the shibboleths that guide our attempts to live a long, healthy life — from the importance of preventive medical screenings to the concepts of wellness and mindfulness, from dietary fads to fitness culture. But NATURAL CAUSES goes deeper — into the fundamental unreliability of our bodies and even our “mind-bodies,” to use the fashionable term. Starting with the mysterious and seldom-acknowledged tendency of our own immune cells to promote deadly cancers, Ehrenreich looks into the cellular basis of aging, and shows how little control we actually have over it. We tend to believe we have agency over our bodies, our minds, and even over the manner of our deaths. But the latest science shows that the microscopic subunits of our bodies make their own “decisions,” and not always in our favor. We may buy expensive anti-aging products or cosmetic surgery, get preventive screenings and eat more kale, or throw ourselves into meditation and spirituality. But all these things offer only the illusion of control.

How to live well, even joyously, while accepting our mortality — that is the vitally important philosophical challenge of this book. Drawing on varied sources, from personal experience and sociological trends to pop culture and current scientific literature, NATURAL CAUSES examines the ways in which we obsess over death, our bodies, and our health. Both funny and caustic, Ehrenreich then tackles the seemingly unsolvable problem of how we might better prepare ourselves for the end…

I think she might be trying to tell me something I want to know – hah hah. (Does she mention applying wry humour to something on a daily basis? I will have to read and find out – I think humour is essential.) I suggest you read the book too, that would please her shade I think (mythological).
