‘Complete anarchy’: Concerns raised over new citizen’s arrest bill
Shopkeepers could soon be allowed to restrain children if they catch them stealing under a new bill introduced to Parliament this month.
The Crimes Amendment Bill would allow citizens to forcibly arrest anyone committing an offence under the Crimes Act by boosting citizenโs arrest powers.
While some support the bill, others have already raised concerns over its potential impacts.
The wider citizen’s arrest powers would not just apply to people stealing from shops, but to all offences under the Crimes Act.
That meant citizens could soon be able to forcibly detain and arrest a person for committing bigamy or an employer carrying out wage theft.

Police have panned Government proposals to enhance citizensโ arrest powers as a backwards leap from the status quo, while also giving the public more freedom to arrest than cops.
This is revealed in police feedback on the proposals, released to the Herald under the Official Information Act, which outline a plethora of concerns.
Among them is the risk of low-level offending escalating into violence, and a lack of clarity on what counts as reasonable force, which police said could open the door to excessive vigilante justice for โtaking a chocolate bar or genuinely forgetting to payโ.
โThe public or retailers may take action they believe to be lawful that could result in either their action being legally challenged, or in the escalation of violence leading to physical harm to the public or the suspect โ or both,โ police said in feedback to the Justice Ministry in December.

Those two are about the only possibilities in an urban environment, though the outcome would ultimately be the same as if you’d done whatever people already do in that situation. Obtaining by deception or causing loss by deception might be another white collar crime passers-by could get on board with, though we’d have to set up secure holding facilities because SFO is usually quite busy. You might be able to get Luxon on having coerced an otherwise perfectly normal woman into marriage, but how could we prove it this far down the track? It’d make for a good trial by media story. I’d even let them take payment for their shocking weekly revelations.
As far as Maori youth vs. ZB Dad, it’d be too easy to bait a ZB Dads into an assault charge to make it worth said Dads while chasing down perceived young hoodlum. He would end up losing everything for the greater crime of being Middle Class While Convicted. The shame, THE SHAME. No one really knows what happened 2 mins previous in a street tussle so ZB Dad might also get clocked for attacking young individual without reasonable cause. General tendency to take upbringing and race of youth into criminal proceeding also does not work in Dad’s favour. He is the person of higher moral standing at all times, so wrestling with children is generally frowned on, even for the sake of a chocolate bar. Police and lawyers workload might increase, but they show no signs of current struggle so perhaps that’s a good thing.
Situations it might usefully enhance could be some far-off farm inundated with gang related equipment theft. But it’d only help to cover genuine accidents that happened while farmer chased away criminals. They’re probably doing ok as it is right now, using whatever unofficial means available.

If a shopkeeper restrains someone’s child around here, even if they’re being a little shite, even if they’ve broken the law, the police will need to mount armed guards outside their shop for the foreseeable future. Opening the door to vigilantes is so stupid.
