Tom Phillips injunction: Media gag order to be argued in court today

An urgent suppression order preventing media, police and Oranga Tamariki from sharing certain information about the Tom Phillips case will be argued in court today.

The gag order was granted on Monday evening, shortly after the Phillips children were rescued from a remote campsite in the Waikato backcountry.

The High Court granted an injunction following an oral application from top lawyer Linda Clark on behalf of Julia Phillips, the mother of Tom Phillips.

It is due to be fully argued in the High Court at Wellington at 2.15pm.

I have been critical of the Police response to the killing of Tom and have argued they operate in a very lax environment where they seem to shoot with impunity.

Michael Laws has just been on The Platform and said that he knows about this case and that Tom was evil but due to the gag order can not say anymore.

I believe that Phillips put his Children in a terrible position, and while I have been critical of the Police tactics, I think that they had almost no alternative options open to them than the one that saw him shot.

I am highly critical of the Police on most cases, I think in this case they had run out of alternatives.

The media gag is still in place.

  1. Well they could have left a message with his parents about the next step and how it would be a clean hands, approach, arrange a meeting outside his parents place perhaps. But they ended up putting spikes on the road. His paranoia was high already.

    Of course doing this 3 years ago, even 2 would have been better. But when Phillips was so busy moving around to keep hidden, and alive, you don’t have much time for thinking things through, just become more miserable feeling. An amnesty with talking time, accommodation in a motel and guaranteed hot meals and cups of tea and a quiet helpful presence in the background for safety and monitoring when and if tempers rose would have probably solved this.

    But why spoil a record of being uncaring and unsympathetic and actually cruel in performance with children despite hoity-toity assertion from authorities – just carry on with Lake Alice mentality. Our welfare system has ruined a large percentage of NZAO families with their authoritarian sadistic ways. When our forebears came here they brought Dickens spirit with them.

      • Do you mean the gummint or me.? When I read the news each day local and international it seems like hell compared to what we thought we would achieve in the 21st century. My feelings – Hotel California stuff.

        • Hotel California is chilling and shows many people could fore-see the rot setting in with the American Dream. Programmed to receive!

          Photos from the camps indicate Mr. Phillips had seen fit to pack home comforts for himself. Have we seen anything indicating that the children were having a good time? Boredom must have been a constant risk among the troops who were perhaps kept busy fetching and carrying. I’m sure they played in the bush when it was new, a novelty, warm. But in winter? Waikato winters, lots of rain and many miserable days. Couldn’t have been much fun and none of them strong enough to be much help building shelters.
          Going for a quad bike ride must have been a highlight for one.

          It all got left too long. Too many people were persuaded that it was only a matter of time and he’d give up. Locals had too much leeway to assist and kept the faith.
          But this year, this winter, there had been a falling out. Someone’s conscience finally got the better of them and they could see that it wasn’t a jolly good adventure, after all.
          It was bloody awful and that person used some tough love on Phillips which forced him out to risk ‘shopping’ in town. He was going to show them! He didn’t need them, he could get his own supplies, thanks very much. Rather than accepting the inevitability of it and taking his medicine, he crossed a line.
          We need to know what drove him to take that stance.

          • He crossed a line long before that when he left the car on the beach and went bush the first time. He was given way too much rope right at the start.

          • Yes, the vehicle on the beach was a diversion that gained him a lot of time while everyone suspected the worst and didn’t want to appear insensitive.
            Locals all spoke well of him and the family and they felt they had to tread carefully for fear of offending someone.
            Some folk are easily offended.
            Hindsight is a wonderful thing.

    I thought that Mr Laws was evil the way he shut me down back in 2022.
    No monster needs be martyred.

  3. If Stuff have done nothing else good they have put up an item containing 34 seconds of police communication with commentary.
    Not long after an officer reports that the quad bike has left the road there are four words on the tape that made up my mind on the police actions “shots fired, shots fired”.

  4. One wonders why we needed expensive police, well trained, ready to go into the army if emergency and just practising on us. A local bunch of right-thinking stalwarts could have hunted them down in short time with the same result at a hundredth of the cost.

  5. Police response was a tragic blunder, yet again. They had the guy after he hit the spikes. A couple of dogs, a cordon and a megaphone would have done the rest. Would have saved the cop a bullet in the head too.

    Just like the Urewera raids when a few taps on the shoulder and a word in the ear would have saved all the drama, they went in gung ho with guns cocked and traumatizing children.

    • There are so many heros and knowledgeable people on this item I am surprised he was able to stay on the run for nearly 4 years.With there acumen the reward should have got them motivated to find Phillips.

      • not often we agree but in this case you are right .Lots of people commenting on a situation they know nothing about .This was in my back yard for the last 4 years and local knowledge is saying most here are talking shit .

    • Wrong. Different situation entirely. If you have a brain use it to differentiate different situations and different solutions. Good luck.

  6. It doesn’t help labeling Phillips a monster. Mark Mitchell did so today showing us all that he is unfit to be a government minister. A responsible minister would have urged judgment withheld until all facts were in the public domain. Responsibility and adherence to process seems anathema to this government.

    • Mitchell knows nothing about any of it and his attitude makes him completely unfit to be anything in govt. He lacks good judgement.
      Your last sentence sums them up perfectly. Remember ‘pretty legal’ from a few years ago. Even I know that it’s either legal or it’s not legal. There is no ‘pretty legal’. And that from a govt. minister. That is their MO with everything.
      Martyn has softened his stance on this. Has there been word from on high?

    Talkback has spoken. Clearly, Phillips must have deserved to have been executed in front of his kids.

      • Correct. And I’d bet there are quite a few out there doing just that, millsy. But smart enough not to involve children.
        This was a big grudge and must have been exhausting.

    • Michael Laws wouldn’t know what to do with himself if he wasn’t screeching like a tree frog in a microwave over talkback radio. Not a lot of work about for a washed up mascara salesman.

  8. It comes down to priorities.

    Do you back an armed recluse into a corner? Do you harass the Green Fairies?

    Or do you use the same level of aggression on wage thieves & P smugglers?

    Under this government it is the former.
