Biden OKs $680m Israel arms sale despite new Gaza ceasefire push: Reports

The Administration of United States President Joe Biden is reported to have provisionally approved a $680m arms package to Israel, even as it asserts that it is pushing for peace in the Middle East. Reports of the arms deal on Wednesday come a day after Biden announced a ceasefire between Israel and Hezbollah and promised to renew efforts to reach a similar agreement between Israel and Hamas in Gaza – one he has repeatedly promised but failed to deliver. To date, Israel has killed at least 44,282 Palestinians in Gaza since the war began when a Hamas-led attack on southern Israel killed at least 1,139 people. Israeli forces have killed more than 3,800 people in Lebanon in the past 13 months.

Israeli forces escalate West Bank raids, detaining 15 Palestinians including a child

In a series of violent raids across the Occupied West Bank as a ceasefire was agreed in Lebanon, Israeli forces detained 15 Palestinians, including a child, on Tuesday night. The Palestinian Prisoner’s Society and Ex-Detainees Affairs Commission reported that Palestinian homes were damaged during the raids, which occurred in Bethlehem, Hebron, Nablus, Qalqiliya, Ramallah and Tubas. The raids were accompanied by assaults, threats, and other abuses against detainees and their families. Palestinian media shared footage showing Israeli forces storming the town of Bani Na’im in Hebron on Tuesday, where they detained a woman and a child.  On Monday, the Palestinian Authority confirmed the deaths of two Palestinians, including a teenage boy, during an Israeli raid on the West Bank village of Yabad. According to the official Palestinian news agency Wafa, Israeli forces entered the village on Sunday night, sparking clashes during which two Palestinians were fatally shot. The victims were identified by the Palestinian Health Ministry as 13-year-old Muhammad Rabie Hamarsheh and 20-year-old Ahmad Mahmud Zaid.

Why experts say Netanyahu has no immunity before ICC as France claims

The Rome Statute has a provision against immunities for senior state officials, including heads of state, but some countries attempt to defy the rule for political convenience. France’s claim that Israel’s Prime Minister Benjamin Netanyahu is “immune” from international arrest after a warrant was issued by the International Criminal Court (ICC) is contrary to international law, experts and judges have said. Heads of state are not immune before the ICC, even if they belong to a state that has not signed the court’s founding treaty, the Rome Statute, according to previous judgements as well as the opinion of leading immunity scholars who spoke with Middle East Eye. All 124 state parties to the Rome Statute, including all EU members, are now under a legal obligation to arrest the pair and surrender them to the court.

France’s argument was previously used by states that refused to arrest Russia’s Vladimir Putin and Omar al-Bashir of Sudan, both wanted by The Hague-based court. But judges have consistently rejected those arguments as contrary to the provisions of the Rome Statute. While some may argue that Netanyahu as a serving prime minister is entitled to immunity before national courts, the rules under international courts are unequivocal in rejecting immunity for individuals under their jurisdiction.  According to Article 27 of the Rome Statute, all wanted persons are equal before the court, including heads of state or government. No immunities under international law may bar the court from exercising its jurisdiction.
