A lot of participants are now under suspicion of being anti-free speech snowflakes. If Bradbury loses in the secret court how will other snowflake suspects clear their names?
This has “HDCA” written all over it.
The matter has the pattern, the consequences, and the process of the legislation.
If I’m right:
a/ There are no absolute defences available under the HDCA Act;
b/ The evidence-in-chief favours how a complainant “feels” about whatever the alleged “harm” is (harm being defined as “serious emotional distress”.
c/ The truth of anything claimed by the Respondent is routinely ignored by the Court (see “a”).
d/ There is a defense under s 21 of the HDCA of “reasonable excuse” if the Respondent does not comply with a Court Order. A Contempt proceeding is where the Respondent can present their defense under this section of the Act.
e/ The Court CANNOT compel anyone to lie, or to make a false statement, or to incriminate themselves (see s 14 NZBORA and associated legislative decisions). If Martyn believes that making an apology would result in these outcomes, he is entitled to raise this defense.
f/ If Martyn publishes an apology that identifies any of the parties in the public domain, and as there is a suppression order in place, Martyn will breach the suppression order by court compulsion to do so. The Court cannot determine that for one order to be advanced (eg an apology), whilst another court order must be breached.
g/ Martyn making an apology he knows to be untrue also risks Martyn incriminating himself under various sections of the Crimes Act 1961.

There will be court injunctions covering this. All the media and the Free speech union could say is that Martin Bradbury is facing court action. Anything else would be contempt of court. It’s an unfair system, as an example, a co worker was accused of a crime, his name was suppressed, I would have been in contempt of court should I have told friends, family that I wasn’t the person who was charged, the cops told me to be careful even if I spoke to my lawyer.

The issue Martin Bradbury is going to court about is likely to be covered by court injunctions. Anyone including the media, and free speech union, would be held in contempt of court, should they say anything other than Martin Bradbury has published on his blog and is going to court. They can’t say anything thing else, some court injunctions can prohibit any one talking about the matter before the court. The FSU may well be involved and may even be assisting, however they could be prevented by an injunction to say anything at all.
