Kim Dotcom MegaUpload case: Court ruling paves way for extradition, but subject to judicial review

The long-running legal battle involving Kim Dotcom has been left unresolved by a Supreme Court ruling issued today.

While today’s ruling paves the way for extradition, it is subject to a judicial review.

The Supreme Court also found the men were not eligible for extradition on the conspiracy to commit money laundering charge, but were on another 12 charges.

The saga continues.

Speaking to Kim, he will fight every step of the way.

    • In my opinion its high time any extradition agreements with the US were quashed if this is how they are going to behave.

  1. Just imagine how hard this would be for an ordinary New Zealander to fight back against this legally? It would almost certainly bankrupt them. The personal toll would be horrendous.

    Anyone too who claims this fiasco wont have a chilling effect in our trust in government and our judiciary is dreaming.

  2. Watch-out those people who run Trade Me. You will be liable to be arrested and charged for taking part in an organised crime ring (racketeering in the USA) if people sell stolen property or copyrighted property on your website even though you do not know that it is stolen or copyrighted and have put safeguards in place to prevent it.

    Kim Dotcom is such a colourful entrepreneurial character without whom we would never have known about the underhand methods the cops and agencies under the Key government used to spy on people and to get him facing the most serious charges – all at the behest of its masters in the USA.

  3. I guess the grand strategy is bleed Kim dry via legal costs – the same thing corporations do whenever the average person attempts to sue them for infringement. Kim has deep pockets, but they aren’t deeper than the state (or Warner Bros.’). Eventually when you inevitably run out of funds to challenge rulings and can no longer mount a legal defence, you get thrown to the wolves, regardless of guilt.
    The Minister of Justice (Kris Faafoi) should just seek to dismiss at this point in a deal that would prevent Kim from suing NZ for punitive damages (although imo all his legal costs to date should be reimbursed by the state).

  4. does any one know what the 12 charges are that the Supreme Court now says are extraditable offenses?
    Especially as the lower courts have ruled that Copywright infringement is not an extraditable offense.

  5. Kim Dotcom was deliberately set up by the treacherous, smirking, arse licking sludge (above pic), acting at the request of the Hollywood motion picture industry moguls. Interesting point is the NZ police were directed by the FBI to carry out the raids on KDC’s home!

    As a legal resident of NZ, KDC and his family should have been protected by the government of the day from any sort of foreign harassment and/or sell out. His technical skills could have been used positively for NZ. However as it turned out instead, the cesspit slime PM of the day was far too interested in keeping sweet with the odious US for his own self promotion.

    KDC could well have been any one of us.

      I lack the technical ability to use the bold thingy, but took the liberty to type in capitals the last statement. You are dead on the money. And you are so bang to rights on that. It could of been your sister, brother, uncle or aunty, mother or father niece or nephew, or friend . All either citizens or permanent resident in NZ.

      The Dotcom saga is a typecast for things to come if this man and his friends are extradited to West Virginia prison cell for New Zealanders. We will pay dearly for letting this happen. We will finally admit what we have suspected all along,- that the govts we have are merely on instruction and caretakers for another foreign power.

      I like simplicity. I do not like clutter. I believe in the simple Old Testament / New Testament concept of ‘Mercy over Justice’. Dotcom was no threat to NZ , but he may have been a threat to a bloated Hollywood Movie Industry who not only shape and influence popular perceptions ( and erroneous ones for the most part ) of history, – but who also dictated the American presidency by blackmailing Barak Obama in threatening to withdraw donations to his reelection if he did not pass their Copyright Laws.

      Dotcom is a typecast of every New Zealander , and their human rights. We are signatories to the U.N Declaration of human rights. We have already failed miserably in that endeavor regards a realistic wage based on the REAL costs of living, living standards, poverty and homelessness.

      In fact we have almost become collective hypocrites because of successive neo liberal govts who work in the areas of denial, buck passing, rorts and lies to cover what is in plain sight of all of us. The Emperor has no clothes syndrome. If Dotcom is allowed to be extradited, … then it says much about the ruling elites contempt for all of us. And how easily they manipulate us.

      It is almost , in another time and in another world in another time,… a repeat of the Dreyfus Affair.

    Good luck to him. This case is showing that persecution is alive and well in NZ! Dotcom didn’t commit copywrite infringement, he’s not eligible for extradition on the conspiracy to commit money laundering charge… WTF have the come up with now to charge him on and why is this expensive and pointless case still trucking along????

    • Any ISP, hosting site, website, news outlet, publisher, citizen or little girl singing her favourite tune on a street corner could be subject to extradition for breaching copyright. Hell, why didn’t the US extradite John Key to America when he stole Eminem’s tune for his political party? It’s ridiculous, no wonder the lower kangaroo courts couldn’t press for extradition. Hence the charges tacked on for money laundering etc. which is what usually happens with these apes: charge in guns blazing and arrest (after illegally spying with the assistance of willing governments on behalf of their celebrity clients), seize assets (illegally) and try to find something that might vaguely incriminate, and then either destroy the person financially or reputationally over time, or try to bully a foreign government into handing over the person while interfering in the sovereign country’s legal system. The playbook was used on Assange only he shared evidence of government murders on the Internet (which the military industrial complex knew about but hid from the public) rather than the b-grade Hollywood movies shared on private servers (which Dot-com could presumably only ‘see’ as anonymised encrypted data bits). Like Assange Dot-com isn’t an American citizen, isn’t based in the US, and so is subject only to our local laws.

  7. And the judiciary still behaves like a rabbit caught in the headlights…. The judges all know this is a “fit up”, yet they are still playing along.. Just how many of our so called “elders and betters” a nothing but tory arselickers who owe their position to political leanings, and usefulness to the colonial power structure foisted upon us by the british? Far more than is good for us, I can tell you that.. The huge amount of money to be made by the lawyers through this charade, is simply a collateral bonus… This case is a test of or sovereignty… If the yanks win, then it’s a fact that the Key government successfully sold us out to the highest bidder… This would have had the crawler Key executed for treason not so long ago, and the “fourth estate” slimmed down once every writer who deliberately withheld the truth, and compounded their crime by making up stories that suited the thieves narrative, had been executed for sedition, and treason…
