Nicky’s family recognise that the DHB, it’s solicitors and the shadowy insurance company supposedly behind this demand, are not adequately informing media of their current and proposed actions, so we have decided to share the information we are getting.
- The Board met today in Hamilton (minus Dave Macpherson) to be “briefed” for the first time on the action (to reopen the Coroner’s Inquest) that has been taken in their name;
- The meeting was inconclusive, and is being reconvened on either Monday or Wednesday next week to be given further information;
- The Crown Law Office has received our family’s request to be given a copy of the DHB’s demand for the re-opening, which has not been supplied by the DHB to the family as is the normal process, and will look at that request as a priority;
- The Crown Law Office is also supplying to the media an outline of the processes followed when they receive such requests;
- Our family has made an OIA request to the DHB for the name of the insurance company supposedly driving this action, and to be informed of the value of the insurance ‘policy’.

Writing as a (retd.) N.Z. Registered Psychiatric Nurse, IMO, it was unbelievable negligence/incompetence of the “staff” in the mental health unit that the so-unwell young man was a patient in, for him to be able to leave the unit & subsequently be found to have committed suicide.
Waste of public money by the guilt-ridden DHB!
of course its the insurance company they don’t want to pay out bloody mongrels but this DHB is bad and has a bad track record Waikato DHB plagued with problems equals poor leadership and poor decision making mostly happened under the last government.
If the DHB’s chain-dragging is due to involvement by an insurance company, that would be truly disturbing.
The system is so structured to give complainants of any king little scope and opportunity to get anywhere.
First there is the ‘gatekeeper’ called Health and Disability Commissioner who only investigates a tiny percentage of all complaints ever received, and then does damned little if a breach of the Code is found to have occurred.
Few cases ever go to the Director of Proceedings and the Human Rights Review Tribunal.
As for any other efforts, inquests and the likes, of course, they get their taxpayer funded expert lawyers employed by Crown Law, to do all to get rid of ‘troublemakers’ who persist, whether right or wrong in their claims and allegations.
It is an uphill battle, look at how others fared, going through the courts, at times to the Court of Appeal and Supreme Court, to get ‘justice’.
“Justice’ is as good as your expert lawyer before the court, whether facts are used and relevant, and whether earlier findings may have given a party the right. So who has the deepest pockets will often determine where things go and end up.
I am not surprised, here they try to reset the case at the lower level of any proceedings, starting with the inquiry.
