  • doing sweet fuck all on cannabis reform and forcing Helen Kelly to be a criminal in her final months of life

A disability law described as a “shame on society” looks likely to be quashed, with a high-level Government committee to consider its repeal today.

Families who care for their disabled loved ones have been fighting to overturn Part 4A of the NZ Public Health and Disability Act since 2013, when its introduction banned them taking discrimination cases over the government’s family care policy to court.

The Herald understands a proposal to revoke the law will go before a Cabinet committee today, and if approved will come before Cabinet next week.

If the repeal goes ahead it would be a huge win for the families. The law’s removal will mean the Government would be obligated to pay all carers – including spouses and parents of the disabled, who are currently unpaid – or it could face yet more legal action.

“I hope they get this right,” said tetraplegic Peter Ray, whose partner Rosemary has cared for him unpaid since 1999.

“The [courts] talked about disabled people being ‘entitled’ to funding for necessary supports. The Ministry still insists l and others with very high support needs are ‘entitled’ to nothing.”

Part 4A was rushed through under urgency by former Health Minister Tony Ryall in 2013 after the then government lost a succession of discrimination cases in court.

Outrage ensued, with leading law professor Andrew Geddis labelling the legislation“constitutionally outrageous” and a “shame on society” as it effectively places the government above the law.

…who the Christ goes out of their way to remove peoples rights to sue the State for discrimination, especially when those people are carers for family members who have serious illness or disability?

As if the lives of these people are not stressful enough, to purposely stop them from challenging the discrimination of the State is a level of sickening repugnance that basic human decency has no other option but to expel from the body politic by projectile vomit.

Every single one of those privileged arseholes should feel ashamed of that law.

  1. yes agree with you Martyn I have no respect for these clowns they are not only greedy and selfish they are down right nasty. After listening to the vile that spewed out of Collins mouth about the meth fiasco she needs to be put out to pastures and so does a few others in this party.

    • Where the fuck was the braying media back then? Where the fuck was the mouth organ Hosking calling for the corrupt Tony Ryall who put the legislation in the depth of the night in urgency to resign?

      So the National government lost a number of court cases through illegal practices, what did they do? Changed the fucking law, that’s what the maggots did. So the right wing creeps that troll these pages, hang your head in shame, that was National’s legacy and you represent them!

    • The government makes its own rules. If something doesn’t work for them, they change it to suit their own agenda. If a law is holding the police back from getting convictions (no matter how dishonestly) they’ll repeal it or amend it to ensure convictions are gained. Plenty of examples of these over the years.
      It is a classic example of an autonomous, self-serving collective.

    But they seem immune to the laws of our country, trampling human rights is there specialty, death and misery follow closely behind them.

I recently wrote to MSD Disability Issues, the Human Rights Commission and my local MP David Clark about all the discrimination have faced with my disability, having a work accident but not bothering to go to ACC because I had a pre-existing condition and subsequently left to the public health system to deal with which has taken a decade to get to this point in time. My issue is that I cant get any help or assistance for my dsability because Im not on a benefit, and I’m not on a benefit because my wife works. As such I am totally reliant on my wife.
    MSD naturally said sorry they cant help, the human rights commission said it was outside their mandate and David Clark didn’t reply.
    I have a friend with Autism, he works in a sheltered workshop and thanks to a Disability Strategy Labour created that National dithered with means he gets paid a percentage of the minimum wage based on his mental abilty and its all legal thanks to legislation created by Labour, so before we go off half cocked at National, Labour too has a part to play on creating this mess.
    Its now impossible for me to work anymore, my good years were wasted waiting for solutions. I did try get work though but as much as discrimination against disability is illegal the look on potential employers faces when I walk in the door for interviews tells a different story.
    This country is truly shocking and its thanks to govt sgnalling the private sector treats us the same.
    Just yesterday we were celebrating equal pay and rights for women but us cripples are still trying to get away from all the discrimination.

    • National did what has been suggested Labour threatened to do back in 2006/7 before Atkinson went to the Tribunal.

      Labour knew back in late 2001 that there was a potential shit storm on the horizon on this issue when the government’s exemption under section 151 of the HRA expired in early 2002.

      And Labour did nothing.

      I’m not holding my breath.

      You may recall the heavily redacted Regulatory Impact Statement that accompanied that amendment..?

      Until all those blanked sections, entire pages are revealed, this sore will continue to fester.

        • Bert, you really, really need to learn the history of this particular issue.

          Previous Labour governments have not covered themselves in glory with their treatment of non-ACC disabled.

          Yes, National rushed through the PHDACT amendment in 2013, but Labour had ample opportunity to sort this order to the 2008 election.

          You ought to pin Ruth Dyson down and have a chat about the issue.

          Like Peter and I did in early 2013.

It seems to me, having done seriously deep research into disability supports under the Misery of Health over the past two decades, that successive governments have appointed the least capable ministers (in terms of disability issues) to handle the Health and Disability portfolios respectively.

    As a consequence of an “I don’t know shit about disability so I’ll rely on the ‘expert advice’ from the Ministry” tactic the Ministry of Health’s corporate machine has been allowed to roll along it’s crushing path unimpeded.

    In my humble opinion only a complete purge of Ministry of Health senior staff will change this.

    They have paid lip service to ‘consumers’, most of whom are from advocacy groups reliant on Ministry funding.

    God forbid that anyone from government would pick up a phone and speak to any of us who have taken the desperate measure of complaining to the Human Rights Commission.

  8. Thanks for not publishing my comment about your exaggeration here while going large on free speech. Though I realise it may be technical, not least maybe my not pushing ‘post comment’.

    The talkers for the people are in my experience more fallible personally than the powerful — no economic reserves to call on, no stupidity as well. But it is a great and right cause despite.
