A huge win for Kim Dotcom from the Human Rights Review Tribunal (my HRRT case is yet to be heard by them because they ‘don’t have the budget to hold the Police to account’ yet)…

Kim Dotcom wins Human Rights Tribunal case, declares extradition bid ‘over’

The Human Rights Tribunal has ruled that the Attorney-General broke the law by withholding information from Kim Dotcom, which he says means his extradition case is “over”.

In July 2015, Mr Dotcom sent an urgent information privacy request to all 28 Ministers of the Crown as well as almost all Government departments, asking for personal information they had on him, including under his previous names.

Nearly all the requests were transferred to the Attorney-General Chris Finlayson, who declined the Megaupload founder’s requests on the grounds that they were “vexatious” and trivial.

The Solicitor-General also said Mr Dotcom had not provided sufficient reasons for urgency.

On Monday, the Human Rights Tribunal ruled that the Attorney-General unlawfully withheld information from Mr Dotcom, meaning he perverted the course of justice.

The Government and Ministers have been ordered to comply with the original requests and supply all relevant documents to Mr Dotcom.

Mr Dotcom was awarded damages for loss of benefit and loss of dignity.
In a series of celebratory tweets, Mr Dotcom claimed this decision meant his extradition case is “over”.

…this isn’t just an enormous win for Kim personally, this is an enormous win to every New Zealander because it shows the checks and balances finally are very slowly kicking into place.

Our Democracy is only as strong as the checks and balances placed upon Executive power and this entire fiasco against Dotcom has highlighted the terrifying lack of accountability to that Executive power.

When Dotcom makes this threat…

…he means it. Now is the time for the new Government to look at cutting a deal with Dotcom before this matter gets to the Supreme Court. The first High Court ruling that went in Kim’s favour has been smacked down by High Court Appeal Judges who were uneducated in the internet and whose arguments will get torn to pieces if it gets to the Supreme Court.

Why should the new Government cut a deal with Kim? If Kim wins in the Supreme Court, the country will be open to a damages claim that will be over $6billion!

To date the Crown of NZ has paid Māori $1.5billion for stealing 95% of the country off them. If Dotcom can take the Crown to the cleaners for an amount that is over four times that which they have paid out Māori for stealing the country, the new Government will face a backlash they won’t be able to survive.

Now is the time to reach out and settle this before the Supreme Court rules in his favour.

  1. To the average layman like myself there was definitely Crown Involvement and meddling in the Kim Dotcom Immigration Saga and the Raids on his Mansion ? IMHO

  2. I must say. The John Key, Bill English National lead government from 2008-2017 is with out a doubt the most incompetent government in history. Bested only by The Ministry of Magic, indeed. Just the financial liabilities alone is greater than the second placed tragedy, land confiscation.

    They can’t even equip the defence force or train police to higher standards and equip with proper gadgets save there iPads. And SIS Director Rebecca Kitteridge is so dumb repeatedly lied and meddled with this case. She can’t even beat one hacker, let alone lead the fight against China or Russia’s or even Americas Putin bots. The Police commissioner and the attorney generals office are a run away train wreck. And yeah call this the dumb team, beta orbiting around their feminine charms. Also immigration and foreign ministries, which are the entry points for any immigrant to clear making them the equivalent of homeland security, has so lousy security clearance. Their disregard for the rule of law, they’ve been attacking New Zealand residents and and citizens. And in my opinion a bunch of terrorist could actually sneak in with out being noticed!!!

    • I think a bunch of terrorist are already here and have been for sometime possibly trying to enter Aus which I believe is harder to enter than our country. The national government made it easier for people like this and some other undesirables. Border security funding, for example like peoples personal luggage not being scanned now we have biosecurity issues.

      • It’s not terrorists we should be worried about but the deep state we have in New Zealand. Not only the SIS, GCSB, Police, Thompson and Clark but also government bureaucrats – Mossad trained, who work hand in hand with these people. Bureaucrats who go to Israel, don’t go there for a holiday.

  3. Let’s not forget that this whole disgusting saga was started by shonkey toadying to hollywood. After the NZ government assisted in destroying Kim’s business and probably his marriage, he definitely deserves fair compensation. This may only be one step towards a fair outcome, but i sincerely hope the keystone cops shoulder there share of the blame (look spike we can do it to, pant pant). Good luck Kim.

    • I think we are lucky it was only 90k. I think Mr Dot Com has a soft spot for us kiwis he knows it was the rotten national government and their cronies but many NZers including myself actually support him and we knew our previous government was in the pockets of the American government. When he came out and said they were collecting mega data he was telling the truth it was our pm who was lying b…..d and he did so throughout his entire tenure.

    • how come our keystone cops didn’t learn lessons from the Tuhoe raids no they went onto to do more damage to our NZ Polices reputation

      • Watching too many movies again…. yep Tahoe raids were an eyeopener then they just kept on going… sad our police and intelligence are just lackies for corporate interests now, don’t forget the harassment of Nicky Hager amongst other things.

  4. My advice to anybody caught in the so called ‘Justice System’ is to get out of the Justice System as soon as possible. If Kim Dotcom can just walk away and this be the end of the matter, he should do it!

    ‘Let go of the past and push on to the good things ahead.’ Don’t strive for revenge or pontificate about how generous you are not seeking said revenge … don’t continually rehash past events either.

    You’re in a good position Kim where the public don’t hate you, the Government here and in the US aren’t really interested in dealing with this drama anymore and your reputation is quite alright … DON’T mess it up!

    Obviously you still have a lot of rawness and bitterness but I’m telling you Kim Dotcom; nobody ever moved forward hanging on to the past. Kim, write it off as a stressful and expensive draw.

    As for Governments, both NZ and the US – if he moves on, stop harassing him and move on too. As for personalities and lawyers, tell them (in no uncertain terms) to drop it.

  5. How serious is perverting the course of justice, what does this mean for the ex Attorney-General Chris Finlayson – is this a criminal offence. The whole thing stinks to high heaven. I hope our Kim sues the bastards for everything they deserve.

    • Did hear through the Grapevine last year there has been Crown Meddling in the Kim Dotcom Affair ?

      • Once Dotcom ditched his previous lawyers who seem to have a lot of government connections, Dotcom started to make a lot more headway on what should have been a straight forward case.

        Even the opposition Sony lawyers knew Dotcom was unlikely to be found guilty in the eyes of the law, right at the beginning.

        Hollywood having no comeback should it all go wrong, why not send a little banana republic government under brother John Key guidance to do all the work, have NZ taxpayers pay for the litigation themselves and take responsibility should it all go wrong?

        It’s like NZ officials in particular under John Key are so stupid and entitled they feel empowered to use harassment and becoming criminals themselves with numerous breaches of the law in NZ in their zealous attempts to please US via Hollywood corporates. Pathetic!

        Not acceptable!! Dotcom needs to win to send a message to our bullying government officials who are happy to use taxpayer money and numerous breaches of the law for zero reason or benefit to Kiwis and actually persecute somebody on behalf of overseas corporates.

    • Absolutely shocking. Criminal charges should be laid to send that message that those at the top have to obey the law just like those at the bottom…

  6. Two things I admire about Kim Dotcom; first, his incredible ability to focus. And second, his sincere appreciation of the fact that for all his intelligence and courage, only his wealth and status have ultimately kept him from being entombed forever in a justice system that daily feeds on the poor and working class like a devouring beast.

    As far as I’m concerned, after this win, KDC would have my nomination for New Zealander of the Year if it were allowed.

    The government should settle, though they probably won’t. This government will probably double down on what started as a bunch of rubes in the Nats govt with stardust in their eyes, getting conned into carrying water for US Copyright interests at NZ taxpayer expense.

    I suppose they thought they could just rendition this guy like they’ve renditioned thousands before him. Once he was “disappeared” into the “justice” system, the spoils would be shared out between them. But they were wrong. So now the courts are beginning to determine that this has all been a massive perversion of justice. Even so, against all reason, this will likely go on to the bitter end.

  8. So former Natz Attorney General Chris Finlayson has been found to have breached Kim Dotcom’s rights. Again, as in the case of Operation Burnham, this issue is not headline news.

    Media still protecting Natz, while the Hirschfield/Curran saga is in your face plastered over most internet news sites! WTF!!!! An incident which is nowhere as bad as that of what Finlayson has done,destroying Kim Dotcom’s life and that of his family.

    Finlayson has to be made accountable for his crime here. I’m sure if any of us ordinary folk had breached the law in the way Finlayson has done here, we would be frog marched to the lock up without question. So why not the likes of Finlayson, Key, English, Joyce et al? They should all be locked away for a good period of time for their crimes against NZ.

    AND NZ media need to get their fingers out of their dumb arses and start working for the people of NZ, through some investigative journalism, reporting and publishing facts, instead of hiding the truth behind Natz BS, misleading NZers in the process!

  9. Kim is very good at opening ones eyes to what the ‘ big players are doing / have done. Fair play to him.
    I still would like him to go for ‘key’ players that caused this whole saga. They are the ones who need to be shown up.
