Just as TDB is juggling the Police wanting to censor us for blogging against Talley’s (and Talley’s have now added TDB to their Court injunction against the Meat Workers Union as ‘evidence’), it appears that we might be the first blog prosecuted under the  Harmful Digital Communications bill…

Tracey Martin Accuses Rolinson of Breaking New Laws

NZ First MP Tracey Martin has claimed Curwen Rolinson is in breach of the Harmful Digital Communications Act, passed in July. In a blog post, Rolinson, former leader of the NZ First youth wing, accused Martin of undermining party MP Andrew Williams.

Speaking at the University of Otago last week, Martin suggested that Rolinson was in breach of the law as a result of a blog post written on 6 July, four days after the Act was officially made into law. 

“I’ve been working on the Harmful Digital Communications bill and what Curwen [Rolinson] did, what Whaleoil [blogger Cameron Slater] does, that’s harmful digital communications,” said Martin.

The Act states that a person is in breach of the law if they intentionally cause harm to someone on the internet. “A person commits an offence if the person posts a digital communication with the intention that it cause harm to a victim,” the law reads. 

Rolinson made accusations last month in a post written on blogging site The Daily Blog. The former youth leader claimed that Martin spread rumours about NZ First MP Andrew Williams in an attempt marginalise him. According to Rolinson, Williams had been flagged as a likely candidate for the deputy leadership role following the 2011 election.

…so this new Harmful Digital Communications bill will be used by MPs to have a go at bloggers who publish things they don’t like?

Hmmmmmmmm. So the Government have all the mainstream media in their pocket and now have the power to shut down blogs.

This is looking less like a cure to cyber bullying and more like a new power to do cyber bullying.

It is claimed Hitler once in power never broke any German law and look at the mess he created.     Not censorship Martyn. Sanitizing for the public good. Keeping the masses minds clean and clear so we are able to concentrate on the important things, such as most glorious leader, puppy dogs, most glorious leader, the ABs, most glorious leader, Richie McCaw’s next honour and the like. And did I mention praising up most glorious leader?

    Coming soon. It will be illegal to say anything negative about NatzKEY, TPPA, Serco, Police, Talleys, Hosking, Henry, Gower, sheep deals, wealthy Saudis, Murray McCully etc!

    Must also keep in mind we can’t blaspheme online either, particularly if it involves most glorious leader and the rest of NatzKEY! Be warned.

    Speaking of ‘you know who’, he is still a no show in Parliament! His absence seems to coincide with the ‘woolly animal’ saga, going back to July. Almost two months now. Can hardly be stood down if he’s not around, pending an inquiry into ‘you know what,’ can he?

    The American Constitution contains a clause that enables the citizens right to bear arms. That right was not included as a self protection against each other but as a deterrent against the rise of an oppressive government. A militia. They were prepared to form a militia against an errant and oppressive govt.

    It is amazing that right back then they knew only too well about oppressive European monarchy’s and govts – and planned and provided for accordingly.

    Now we are headed towards the first steps of that oppression. The curtailing of the democratic right to express an opinion.

    You know one thing I admire about the Americans is their rugged adherence of the right to free speech. They have that saying ” I may not agree with what you say but I will defend to the death your right to say it ”….

    And THIS ….demonstrates perfectly just WHY the Americans thought this way.

    New Zealanders , …the things that have been going on all this time under this ‘PM’ key …..are now reaching a crescendo. There has NEVER been …a more dangerous and anti democratic PM in this country ever before compared to this character.

    He must go.

    With no ceremony . No accolades. Just an unceremonious dumping at election time 2017.

    • I agree with everything you say except the voting bit. People are starting to wake up to this elitist oppression, however if you think it will be any different under another party I’m sad to say you are mistaken. There is no democracy, only the illusion of democracy.

  5. Actually the bill is working well. It aims to prevent harmful communications. In the National’s government’s jaundiced view – any communication that criticizes the government or its rich mates is instantly harmful – so the bill does exactly what it was intended to do. The problem was that most of the sleepy hobbits didn’t know that was the intention. They thought of harmful being the old fashioned sense of the word so they kind of imagined that harmful communications meant things like bullying, threats, child porn, etc., not opposition to the government. Oh my you stupid sleepy hobbits! We tried to tell you but you didn’t listen! Shutting down the opposition blogs is the first step. Soon our free press will be as free as China’s.
    Wonder how the establishment apologists will spin this one on freedom.org.

    My deep and secret fear with regard to the Interweb is that if it’s so great and amazing , as it is of course , then how terrible would it be if it were to be removed suddenly. Even the thought of that is too terrible to countenance .

    • Opposition Parties now need to meet in a emergency forum to discuss how they can combine place a court injunction to have half the state owned media RNZ & TVNZ over to them for presentation of their policies and daily public presentations of the state of the Nation and the Government activities this now needs to be done, TO PRESENT A MADIA THAT IS FAIR AND BALANCED.

        Actually i am not so pessimistic….We armchair activists will probably finally get off our bums and away from our computers and go out and do what they did last century and before in the Labour and human rights movements

        ,..ie take to the streets, general strikes, 1968 marches for education ( like the French)…marches for everything, human rights , housing for New Zealanders. New Zealand for New Zealanders, marches for the environment, anti war, anti corporate control , pro-democracy marches…pamphlets, posters , new worker newspapers, community meetings, soap box speeches

        Actually if internet freedoms are taken away this may unleash something else…this could be the beginnings of something BIG and positive…a new sense of community and action

    Any politician who attempts to use this new law to silence critics will not come out of this looking good.

    • Maybe we should carry on as before,write what we like,this bill is intended to silence dissent, well we need to all write enmasse,be honest about our views,we need to support the TDB and Martyn .
      Why should we be silenced to suit John Key,he will carry on making more and more laws to suit himself,until we are silenced completely.If we don’t stand up to him now, when will we?
      Nothing to fear except fear itself.People in other countries fear their leader to an extent that that leader gains more and more power to control ,its up to us to be non compliant.
