National Party sued over Eminem copyright infringment

US rapper Eminem is suing the National Party for allegedly breaching copyright by using his song Lose Yourself in its campaign advertisements.

The Detroit-based publishers of Eminem’s copyrights have filed proceedings in the High Court at Wellington today.

Eight Mile Style, LLC and Martin Affiliated, LLC are seeking damages for copyright infringement against the New Zealand National Party.

The proceedings stem from allegations that unauthorised use has been made of Eminem’s Grammy and Academy Award winning song Lose Yourself in election campaign advertising run by the National Party in the lead up to the general election.

“Eminem’s publishers were not approached for permission to use any of Eminem’s songs for this campaign advertisement,” said Joel Martin, speaking on behalf of the publishers.

“It is both disappointing and sadly ironic that the political party responsible for championing the rights of music publishers in New Zealand by the introduction of the three strikes copyright reforms should itself have so little regard for copyright.

“We do not hesitate to take immediate action to protect the integrity of Eminem’s works, particularly where a party, as here, has sought to associate itself with Eminem and his work.”

…I’m guessing National’s defence to being sued by Eminem is that they’ve spent 6 years stealing ideas from Labour so they thought it was cool.

All this demands a new version of ‘Lose Yourself’ befitting MC John Key. Will the real slim shady please stand up?

    Has the FBI been notified, because it can authorize our police force to do an early morning raid on National party headquarters, or better still the residence of FJK, then extradition to the US to face charges!

      Lets show Uncle Sam we really mean business and swoop down over JohnXKeySCORES house with about 80 paramilitary police clad in black combat fatigues armed with semi automatic rifles , rough up him, his wife and his bodyguards and then throw JohnXKEYSCORE in prison for a few days…..and then maybe …we could freeze all his assets!!! Including that house he owns in Hawaii!!

      After that…maybe we can get the MSM to deride and demonise him publicly for 4 or 5 years and call him names – like – I know…lets say hes got a face like a butt or something !

    • Pretty ironic to be sure. Wonder if the lawsuit bankrupts the National party, as the lawyers probably won’t accept anything less than a few million due to the scope to the copyright violation – National are political party organization not an individual. All the music I use on the internet I buy the rights for, but clearly National has no respect for the copyright it claims to uphold, when National breaches copyright so blatantly for political purposes.

    “Just lose it” – What we’re all praying for come Saturday
    “Just don’t give a f**k” – Speaks for itself really
    “Kim” – Appropriate
    “Guilty Conscience” – Because surely ONE of them must still have the remains of a conscience inside their head
    “Love the way you lie” – A love ballad to JK
    “Bad Guy”, “Brainless”, or “Brain Dead” – (I can’t believe these are all actual titles!)
    “Desperation” – The general theme of the Nats these past couple of weeks

  3. Copyright infringement huh… So when will John Key’s mansion be raided by police in an obscene overuse of military style force, his assets seized, accounts frozen, and thrown in jail all without trial???

    Failing that – can we just have him extradited anyway?

  5. Snh, snh, snh. Mind you, if I were true to myself I should probably come down on the Nats side on this one. I have long argued that the whole field of copyright, trademark and branding, and of intellectual property (so called) ought to be completely overhauled … with a view to wholesale liberalisation.

    At the moment copyright law benefits the big corporations, who, by the way, can themselves get away with breeches of copyright, failure to pay due royalties, claiming royalties on copyrights they don’t hold, bogus claims for copyright for material in the public domain. To take one instance, John Key’s pals, Warner Brothers is notorious for these types of rorts and frauds. Just ask (for example) James Taylor.

    And now I hear that Warner Bros is suing a small NY pub for use of songs to which it owns the rights. yeah, rigjht: one is 80 years old – definitely in the public domain (unless the US has, at WBs behest, changed the law of copyright in this regard).

    Here’s a thing. What is the status of parody in view of current law concerning copyright? A year or so ago I penned a parody of ‘Jealous Guy’ running to four stanzas that I called ‘Average Guy.’ If I were to sing this in a pub, for pay (I haven’t actually), would that make me liable to royalties to whoever owns the rights to that John Lennon number? Seriously??

  6. You would think that the PM of NZ would have known about Copyright Infringements? TWO types of licenses: a master use license (controlled by the record label) and a synchronization license (controlled by the publisher). John Key can’t blame anyone else because it has been aired on TV and Internet?
